About J.

The values I bring to my law practice — hard work, client service and giving back to the community — may be old-fashioned, but they are not outmoded. They come from my experience with youth fellowship at Christ United Methodist Church when I was growing up here in West Virginia. They come from Cub Scouts and 4-H, and from our excellent public school system. Later on, my values were shaped by the Linsly Military Institute, where I attended 8th through 12th grades. I graduated from West Virginia Wesleyan College in Buckhannon with a B.A. in government and history. I received my law degree from the West Virginia University College of Law. After law school, I served four years in the U.S. Air Force Jag Corps, where I earned the Air Force Commendation Medal. After attending the Skip Barber Racing School in Connecticut, I raced for two seasons with the Sports Car Club of America, finishing second in my class the second year. I’ve got the competitive and strategic nature required for success in both auto racing and the practice of law. During the 1990s, I was the recipient of the West Virginia Trial Lawyer Association’s (now West Virginia Association of Justice) Member of the Year and President’s awards. I have also served as president of the Upshur County Bar Association.

About My Fees - Free 20-minute phone consultation In my family law and civil practice, we usually operate on an hourly rate. Please keep in mind, that rate reflects my expertise as a lawyer with over 30 years experience, my staff of five people, and the overhead that such an operation requires. There are less experienced attorneys, some with no staff, who appear to charge a lower rate, but, remember, you may be paying that attorney to type your pleadings, take them to the clerk's office, and mail out your bills. Even at $100 to $150 per hour, that’s pretty expensive clerical pay. My most typical hourly rate is $200/hour.

How did you build a successful practice?

Hard work, regular continuing legal education, membership in professional organizations, careful preparation, a cost effective marketing plan, compassionate representation of clients, a well-managed office, and competence in law office technology.

What should clients look for in a lawyer?

A. Experience; B. Compassion; C. Intelligence; D. Ability to think on his feet.

How important is local knowledge to the success of your cases?

As a small town lawyer, 6000 in our city, 20,000 county, surrounded by similarly small cities, local knowledge of the judges, the geography, the people, is essential.

What information can you provide in a free phone consultation?

1. I take a quick history; 2. Based on history, we go over caller's options; 3. We can usually quote a retainer and hourly rate; in contingency fee case, the percentages, and likely chance of success. If client elects to have a robust face to face consultation before retaining, we can quote a guaranteed consultation fee; for that fee, we have handouts, articles, copies of statutes, and can even ghost write certain documents. Once client sees the rather daunting challenge, they often go ahead and retain us, but there is no obligation besides that flat fee.

What information do you need in a free phone consultation?

Location of dispute; names of disputants; nature of controversy; dollars in controversy; ""white elephants"" such as opioids, alcohol, drugs, contributory fault, etc.

What differentiates you from other lawyers in your community?

I am an original thinker; my blog has 1400 pages, 380 articles, fully searchable. Vast experience, humor, passion, energy, and a protective nature.

What is the most rewarding aspect of your job?

Helping individuals climb out of a dark pit or deep problem, getting a fresh start, teaching a way to gather information and organize a plan, and giving them the tools to protect themselves and family in the future.

What are your other interests in addition to law?

Almost too many to list; reading history, biography, science fiction, the future; politics, writing; computer technology, WV Irish Road Bowling; photography; pottery, and using awd Kubota to maintain 10 hilly acres. In past, sports car racing; now, having a hot set of wheels; Ford Focus RS, helping me stay young. My wife, children, and grandchildren, and two great pets, Duffy and Chloe.

Are you involved in your community?

Have sung in our church choir 25 years; historically; chair of the United Way; boards of the Family Resource Network and senior center, Rotary, 17 years of Youth Soccer; WV Trial Lawyers' Peoples' Law School; Board member for 25 years; Progressive Bank Board for 20 years. Recently member of WV State Bar Board of Governors. Regular Continuing Legal Education Presenter; Recipient of WV Trial Lawyers' Member of the Year and President's award. USAF Commendation Medal.
