About James

James S. Gleason is a Partner and Chair of the firm’s Labor and Employment and Litigation practice groups, as well a member of the firm’s Executive Committee. Jim is an experienced trial attorney who has successfully represented businesses of all types in litigation involving discrimination, wage and hour issues, ERISA claims, unfair competition claims, commercial disputes, and personal injuries.

Jim’s practice includes litigation in both federal and state courts, as well as numerous administrative agencies, including the Occupational Health and Safety Administration (OSHA) and the National Labor Relations Board (NLRB). Jim has also handled a number of arbitrations. Jim also represents hospitals and physicians in medical malpractice actions and in matters before the Office of Professional Medical Conduct (OPMC).

Because of his experience, Jim is regularly called on to serve as local counsel for class action lawsuits and other complex litigation. An experienced appellate lawyer, he also handles appeals in New York state and federal courts.
His dedication to his clients and his superior litigation skills have earned him fellowship with the American College of Trial Lawyers. He is regularly included in Super Lawyers and the Best Lawyers in America. Jim has been appointed to the Advisory Group of the New York State-Federal Judicial Council, a council which advises the courts on issues of joint interest to the state and federal judiciary. The 37 member advisory group consists of attorneys and judges appointed from across New York State.

In addition to his litigation practice, Jim counsels business clients regarding compliance with anti-discrimination and other labor laws. He is familiar with the challenges facing modern businesses and has assisted both unionized and non-unionized businesses in structuring reductions in force that comply with anti-discrimination laws, labor laws, and the Employee Retirement Income Security Act (ERISA). He has counseled clients regarding negotiations and implementation of changes to retiree medical benefits plans and on issues involving subcontracting of the workforce.

Jim is a frequent lecturer on litigation and labor and employment topics. A strong advocate of mentoring young attorneys in litigation skills, his presentations have included continuing education courses on practical trial skills, handling voir dire, evidentiary issues at trial, and New York Supreme Court practice. He also provides training for clients on issues such as anti-sexual harassment and discrimination, handling employee discipline, and best employment practices.
