For 30 years Rusty Tucker has been fighting for justice for his clients in a multitude of business and personal injury litigation matters. Having spent the first 10 years of his career working for large law firms early in his career working for clients such as Exxon, Tenneco, Fina, Chase Bank, Bank of America and other Fortune 500 companies on defense matters for them, Rusty learned all the tricks of the trade used by defendants and their attorneys.
For the past 20 years since forming his own law firm in 1992, he has devoted his practice 100% to representing Plaintiffs in a variety of business and personal injury litigation matters with phenomenal success. Most all of those cases were and are handled on a contingency fee basis, meaning that there are no attorney's fees or expenses incurred by the client unless there is a recovery. In his very first jury trial after starting his firm, he obtained a $3.1 Million verdict in a wrongful death case (case settled for $250,000 due to damage caps that applied) in which the insurance company for the City involved had offered $25,000 to settle before trial. Mr. Tucker is well respected by the defense lawyers who Rusty has litigated against, and he has received numerous referrals from lawyers he has litigated against (including one major case where the referring lawyer's mother had literally caught on fire during an operation--case settled for a confidential amount).
Mr. Tucker has what most Plaintiffs' attorneys do not--the ability to level the playing field against well funded opponents, as he has the wherewithal to monetarily fund substantial, complex litigation. Most importantly, the Defendants know that as well. Whether he needs to advance $100,000 or more in expenses to bring your case to justice, Rusty is willing to do whatever it takes to obtain a successful result for his clients. Some examples of Mr. Tucker's success: In 2001 he obtained a $50 million verdict that was profiled in the National Law Journal in a special issue devoted to the Top 100 verdicts that year in the entire US(case settled for much less in a confidential settlement due to wrongful death damage caps that applied). In another well publicized case by the local and national media, he obtained a CONFIDENTIAL SETTLEMENT in one of the largest medical malpractice settlements on record in the State of Texas.
When one of Rusty's clients had a manufacturing plant burn down that was shown nationally on The Today Show and other morning news programs, the insurance company refused to pay the insurance proceeds and business interruption insurance, claiming arson was a factor (when there was absolutely no evidence of arson). Not only did Mr. Tucker get his client all $6 million in insurance proceeds paid, but he also obtained substantial confidential settlements from 3 defendants in additional bad faith insurance damages.
Mr. Tucker also successfully represented over 2000 shareholders in a major securities fraud lawsuit against a large publicly traded company in litigation in several forums and multiple states against a major international law firm which resulted in tens of millions of dollars being paid to his clients and others as a result of securities fraud perpetrated by the defendants involved. He has obtained multimillion verdicts and settlements in a variety of medical malpractice and personal injury matters due to medication errors, surgery errors, and drugs withdrawn from the market such as rezulin and fen-fen. He has represented close to 100 victims of gas well blowouts and recovered substantial recoveries for his clients for their injuries and property damage, including a massive sour gas well blowout.
