From Attempted Murder to 3 years
Galen Allen was charged with attempted murder, but after a zealous defense, he pled to lesser charges and received 3 years in prison.
Diontae Smartt is a teenage boy charged with rape of an elderly man in Chattanooga's North Shore. I represented Diontae in Juvenile Court, where the judge decided he would face trial as an adult.
Please describe a case in the last year or two where you made a big difference.
In August 2014 I was asked to represent a 13 year old boy charged with attempted first degree murder. The State was asking to transfer the case to criminal court, where the child could have faced a potential sentence of 15 years minimum in prison if convicted of the adult offense. By working with an expert in witness identification and diligent discovery, I was able to get the child's case dismissed. As it happens, the witnesses had mistakenly identified my client as the shooter, only later to tell police that he had not been involved at all, and instead had only witnessed the incident.
How did you build a successful practice?
Any success I've enjoyed as an attorney has been by the grace of God and from listening to the advice of more experienced attorneys. I would say that my strengths as a lawyer lie in my ability to relate to my clients and communicate on their level. I spent 10 years in the restaurant industry prior to law school, and I come from a blue collar family, so my clients enjoy a high level of customer service that is focused on making sure they understand the legal process without being talked down to or lectured. I'm still a server at heart, so anticipating my clients needs, listening to their stories, and responding appropriately to their questions comes more naturally to me than it may another attorney.
What should clients look for in a lawyer?
When seeking representation, clients should look for a lawyer who sees themselves more as a servant and less as a crusader. Some attorneys care more about their bottom line or their win/loss record. I think attorneys who put client satisfaction and a just resolution are more effective than someone who is looking to bill as many hours as possible.
How important is local knowledge to the success of your cases?
Local knowledge can be immensely helpful, mostly by streamlining the process. For instance, I do a lot of work in Hamilton County Juvenile Court, so I'm much more familiar with its staff, processes, schedules, etc., and can therefore predict and navigate the path a case will take. That said, attorneys are trained to adapt to the local rules, and so long as your nice and polite and don't assume an entitled attitude, people in this area--East TN & Northwest GA--are going to help you out.
What information can you provide in a free phone consultation?
A free phone consultation will be a general, surface level, evaluation of the case. Phone consults can be valuable in terms of issue spotting, overviewing the law, and projecting possible paths to success and obstacles to be expected.

What differentiates you from other lawyers in your community?
What sets me apart from my peers is that I do have experience outside the law. I did not become an attorney until age 35, so I had a whole life before I became an attorney. Also, I'm a first generation college graduate, so I grew up in circumstances much closer to what my clients--ie, poor and lower middle class--experience than what many of my friends may know. Also, I myself am a single parent raising 2 boys with their grandmother, so I also know what it is to have a non-traditional family.
What is the most rewarding aspect of your job?
The most rewarding aspect of my job is getting to make a real difference in someone's life. Whether it's a criminal matter or a divorce/custody case, these are issues that affect people's entire lives. I like being in a position to help when critical issues are at stake.
What are your other interests in addition to law?
In addition to law, I love the theater. I also enjoy photography, travel, cooking, history, and of course college football! My greatest passion, though, is being a daddy to my twins, Colin & Seth, who are affectionately known as The Bubbas.
