Mr. Kahn represents clients in water right and other water related areas, including litigation, water quality and transactions. He has worked in these areas for over thirty years.

Mr. Kahn has litigated numerous water cases in the Colorado courts. His Colorado Supreme Court cases include:

  • Aurora v. Simpson, 105 P.2d 595 (Colo. 2005), standards in a plan for augmentation.
  • Board of County Commissioners v. Park County Sportsmen's Ranch, LLP, 45 P.3d 693 (Colo. 2002), standards for underground storage of water.
  • Park County Sportsmen's Ranch, LLP v. Bargas, 986 P.2d 262 (Colo. 1999), scope of nontributary groundwater.
  • South Adams County Water and Sanitation District v. Broe Land Co., 812 P.2d 1161 (Colo. 1991), administration of water rights.
  • Zigan Sand & Gravel, Inc. v. Cache La Poudre Water Users, 758 P.2d 175 (Colo. 1988), replacement of water depletions caused by gravel mining.

While at the firm, Mr. Kahn has done work for the State of Colorado in drafting and assisting in the promulgation of the nontributary ground water rules, represented the St. Vrain & Left Hand Water Conservancy District and other clients in the trial of the United States Forest Service claims for reserved instream flows in the South Platte River basin, and represented several local governments resisting the claims for export of water made from Park County.

While at the Colorado Attorney General's office, Mr. Kahn specialized in water rights matters and was involved in several reported appeals including:

  • Giffen v. State of Colorado, 690 P.2d 1244 (Colo. 1984); and
  • R.J.A., Inc. v. State of Colorado, et al., 690 P.2d 823 (Colo. 1984), both involving water salvage claims.
  • Broyles v. Ft. Lyon Canal Co., 638 P.2d 244 (Colo. 1981), changes of water rights

He also regularly represents buyers and sellers of water rights in water right and real estate transactions.

Mr. Kahn's clients include local governments, water districts, water conservancy districts, irrigation companies, landowners and developers.Mr. Kahn is a past director of the Boulder County Bar Association and the Boulder County Bar Foundation and is a past chairman of the Natural Resources Section of the Boulder County Bar Association.  He is a member of the Water Section of the Colorado Bar Association and the Natural Resources Section of the Boulder County Bar Association.  Mr. Kahn is also a director of the Boulder County Campaign Committee of the Legal Aid Foundation of Colorado.
