  • The firm of Price, Smith, Hargett, Petho and Anderson, located in Charlotte NC & Rutherfordton NC, has a consistent record of success in cases involving serious injury and death. $9,000,000 recovered for a severely brain damaged young woman who was involved in a motor-vehicle truck collision. She is living with the care of her family through the benefit of a trust provided with the settlement funds. $4,775,000 recovered for a young woman who suffered brain damage and became comatose as a result of anesthesia toxicity. Over $4,500,000 was paid to our client who was rendered a quadriplegic as a result of a motor-vehicle accident in a construction zone. The successful claim was made against the road construction company and the state based upon allegations that the construction work had created a lane shift with a significant drop off causing a roll over of the vehicle. $3,000,000 was recovered for a client rendered a quadriplegic as a result of a semi-truck dropping a load onto the client's car. The theory of recovery was based on failure to secure the load. $2,500,000 recovered in a workers’ compensation case for a construction worker who sustained a spinal cord injury causing paralysis when he fell at work. As the result of his injury, our client was unable to care for himself. We successfully argued that the workers’ compensation carrier was obligated to pay his wife for the care she provided to him (attendant care). The case settled after trial but before the Judge issued a decision. The settlement is one of the largest workers’ compensation settlements in the history of North Carolina. $2,300,000 recovered on behalf of a workers’ compensation client who suffered multiple spinal injuries due to a fall at work. Our firm successfully argued that the workers’ compensation carrier was obligated to pay attendant care to his wife, to provide handicapped accessible housing and handicapped accessible transportation for the remainder of our client’s lifetime. The case settled before trial. $1,900,000 award was achieved through arbitration and mediation on behalf of a young man who sustained a mild traumatic brain injury as the result of a motor vehicle collision. Our firm retained experts in the fields of neurology, neuropsychology, life care planning, and a vocational expert to successfully pursue our client’s claim. $1,600,000 recovered for a client suffering brain injury when material was dropped from a crane overhead at a construction site. The case had contested issues both with regard to third party liability and workers' compensation benefits. $1,425,000 recovery for a client suffering a brain injury as the result of a work-related injury. $975,000 recovered for the wrongful death of an individual who suffered anesthesia toxicity and was not resuscitated. $900,000 recovered for an individual struck by a commercial truck causing 2 broken legs and extensive surgery. A $500,000 verdict was received in Rutherford County, North Carolina for wrongful death as a result of alleged medical malpractice. We understand this to be the highest personal injury verdict or medical malpractice verdict in this county to date.
