Please describe a case in the last year or two where you made a big difference.
The case that jumps out the most is State of New Mexico v. James Bogart in which Mr. Bogart was charged with First Degree Murder. After challenging the prosecutors' misconduct at two different grand juries, the case finally went to trial in December, 2013. The jury split on the verdict and a mistrial was declared. At the retrial in April 2014, Mr. Bogart was found not guilty of Murder.
How did you build a successful practice?
The Lahann Law Firm built its success on the skill and reputation of our attorneys and on making client communication priority #1. What should clients look for in a lawyer?
First and foremost is the lawyer's experience and reputation in handling matters just like yours. For example, if you have been charged with a complex white-collar crime, you should only hire and attorney with proven experience and success in trying white collar crimes; hiring a lawyer who primarily handles DWI cases is a recipe for disaster in a case like that.
How important is local knowledge to the success of your cases?
It's absolutely critical! Every district is different - there are "unwritten rules" about procedure and case flow. You want a lawyer who is in the courthouse on a regular basis and has working relationships with the prosecutors, police, probation officers and judges.
What information can you provide in a free phone consultation?
Mainly, I can provide a road map for what will happen generally in their case. I cannot provide an exact analysis or predict an outcome - no attorney can - but I can give a prospective client good information about what to expect next.
What information do you need in a free phone consultation?
Documents, documents, documents! Any piece of paper you have received from the police, the courts or the jail should be right in front of you. The more information you have, the more accurate my initial analysis can be. Also, be sure to tell me about your job, security clearances, licenses that might be on the line if you are convicted.
What differentiates you from other lawyers in your community?
Trial experience. In 23 years of practice, as a prosecutor and a defense attorney, I have tried well over 200 felony cases in front of a jury. Everything from Shoplifting to First Degree Murder. I think I've earned a reputation as someone who is always willing and ready to go to trial, and I have a proven success rate for my clients at trial.
What is the most rewarding aspect of your job?
Consistently achieving my clients' goals. There is nothing like the relief on my clients' faces when I have been able to get evidence suppressed or their cases dismissed.
What are your other interests in addition to law?
Day to day, I enjoy reading and writing fiction. My wife and I enjoy traveling across the country.
