A ninth generation West Virginian, John A. Proctor, Esq. is a Huntington native with both a B.A and an M.A. in History from Marshall University and his Juris Doctorate from West Virginia University College of Law. An experienced trial lawyer with an emphasis in family law, criminal defense and civil litigation matters, including personal injury, Mr. Proctor is also a graduate of the National Trial Advocacy College at the University of Virginia. Please describe a case in the last year or two where you made a big difference.

There are two or three that come to mind. The first was a case where a gentlemen was wrongfully accused of sexual abuse of his ex-wife's daughter. The allegations had been engineered by his ex-wife and she convinced her daughter to make the allegations in order to gain leverage in a custody battle for the other children. We took it to trial and got an acquittal on over 100 charges for which he would have received a life sentence. In another case, we had an estate case where an elderly woman who was estranged from her daughter and had not spoken to her for several years left her estate to the gentleman who had provided for all of her care and comfort during the last several years of her life. Her estranged daughter had challenged the will and we were able to get the case dismissed on summary judgment and preserve the client's wishes that her daughter not receive anything from the estate.

How did you build a successful practice?

By attempting to always do what was best for my clients even if it cost me potential fees and always keeping open communications with my clients.

What should clients look for in a lawyer?

Someone who is willing to always answer their calls, meet with them and tell them the truth no matter how painful.

How important is local knowledge to the success of your cases?

Very. It takes a great deal of time to build relationships with the Judges, prosecutors and other attorneys so that they know you will deal with them honestly but fight for everything your client deserves.

What information can you provide in a free phone consultation?

That depends on the complexity of the case and the type of case. That is why we always try to set up a free face to face consultation in the office which will allow both the client and the attorney to fully review all the necessary documents and information and garner a full understanding of what the client is hoping to achieve.

Once again that depends on the type of and complexity of the case.

What differentiates you from other lawyers in your community?

I generally get to the office by 8:00 am and will always return calls.

What is the most rewarding aspect of your job?

Helping my clients through what is usually the worst time of their or one of their family members lives.

What are your other interests in addition to law?

My family, Marshall University Sports, fishing and golf.

Are you involved in your community?

Yes, I am an active member of my church and am involved in several projects attempting to bring economic revitalization to the not only the Huntington area but the entire state.
