About John
John D. D’Ercole is a partner in the Firm’s Litigation Department. Mr. D’Ercole specializes in a broad range of Federal and State complex commercial litigation including issues involving contract disputes, real estate, insurance coverage, antitrust, securities, the Racketeer Influence and Corrupt Organizations Act and intellectual property. He has tried cases in both the State and Federal courts of New York and also has extensive appellate experience in these courts.
Mr. D’Ercole has been involved in several notable cases including: In The Matter of Duty Free Shops Arbitration (arbitration of multibillion dollar shareholder dispute involving the sale of Duty Free Shops to Louis Vuitton); Grupo SIT v. AT&T Communications, Inc. and Harris Corp. (action for breach of contract and fraud involving defendants’ sale of a satellite telecommunications system in Mexico); Barr Laboratories v. Abbott Laboratories (federal jury trial and appeal of claim by generic manufacturer charging branded manufacturer with monopolization of market for erythromycin drugs); Automobile Club of New York, Inc. v. Port Authority of New York (federal bench trial and appeal in action to lower bridge tolls on Port Authority bridges and tunnels).
He graduated summa cum laude from Fordham University with a Bachelors of Science degree in Finance. He received his Juris Doctorate degree from Brooklyn Law School and graduated cum laude. While at Brooklyn Law School, Mr. D’Ercole was the Primary Notes Editor for the Brooklyn Journal of International Law and authored a Case Comment entitled, Verlinden B.V. v. Central Bank of Nigeria: Finding the “Original Ingredient” in the Foreign Sovereign Immunities Act, 10 Brook. J. Int’l L. 543 (1984).
After law school, Mr. D’Ercole clerked with the Honorable Joel J. Tyler, United States Magistrate Judge for the Southern District of New York. He is admitted to practice in the State of New York, the United States District Court for the Southern and Eastern Districts of New York and the United States Court of Appeals for the Second Circuit. He is also a member of the Association of the Bar of the City of New York.
