IN RE: JASON ANDRE CAFFEY, DEBTOR. JASON ANDRE CAFFEY, PLAINTIFF, V. KAREN RUSSELL, DEFENDANT

Plaintiff: Attorney for the plaintiff, Jason Andre Caffey. In August of 2007 the plaintiff filed for Chapter 11 bankruptcy, citing his numerous child support obligations as cause. Caffey, a former NBA player, fathered several children during his time in the NBA. His child support payments were based on his salary while he was playing for the Chicago Bulls. One of his debts was the Karen Russell, whom he owed over $82,000 in back child support. Russell filed for a writ of arrest in an attempt to collect the debt. Caffey was arrested and hired Fisher as his new domestic relations counsel, Fisher subsequently negotiated Caffey's release. This case was to contest the actions take by Russell and her attorney's. During the hearing it was found that both Russell and her counsel knew of the bankruptcy case and intentionally acted to cause Caffey to be incarcerated. This act was seen as a willful violation of the stay. Caffey also contends that the actions taken by Russell caused him emotional distress due the high publicity the matter had received and had cost him over $30,000 in income because he was unable to proceed with business ventures after his arrest. The court found in favor of the plaintiff and awarded him $40,000 in damages. In addition, the defendant was ordered to pay the legal fees for the plaintiff.
