Adverse Possession Claim
We represented the defendants in a case where the plaintiff alleged she was the owner of a real property by adverse possession. Plaintiff’s complaint asserted a cause of action of quiet title via adverse possession. Following bench trial, the plaintiff was denied a ruling establishing adverse possession in her favor, and that she had no right, title, or interest in the property. Result: Ruling in favor of our client; claim dismissed.
Breach of Contract
We defended our client in an action for breach of contract arising from the sale of a mixed-use property. We filed a cross-complaint alleging causes of action of: (1) Breach of Fiduciary Duty; (2) Negligence; (3) Negligent Misrepresentation; and (4) Constructive Fraud. After establishing the dual broker failed to meets its duties to both the buyer and seller, we obtained a favorable settlement at mediation with no out of pocket expenses for our client. Result: Obtained favorable settlement in mediation.
Contract Dispute – Reformation of Written Instrument
We defended our client in an action for (1) Reformation of Written Instrument; and (2) Declaratory Relief. Plaintiff brought the action, related to a promissory note and deed of trust, alleging that the deed of trust had an incorrect amount indicated therein. We, in turn, contended that the deed of trust included the correct amount, and thereafter unearthed evidence to support our conclusion. Plaintiff dismissed the action, and the parties are negotiating a return of attorneys’ fees incurred by our client in defending the action. Result: Obtained dismissal of action.

Please describe a case in the last year or two where you made a big difference.
Delman Vukmanovic LLP represented the defendant and cross-complainant in the purchase of a commercial property with undisclosed environmental problems. The complaint alleged causes of action of: (1) breach of contract; (2) breach of the covenant of good faith and fair dealing; (3) specific performance; (4) declaratory relief; and (5) conversion. We filed a cross-complaint for: (1) breach of contract; and (2) declaratory relief. Following bench trial and post-trial briefing, the court entered judgment in favor of our client on the complaint, and awarded all requested damages sought in our cross-complaint.

What differentiates you from other lawyers in your community?

What are your other interests in addition to law?
I enjoy outdoor activities such as hiking, mountain biking, surfing, and paddle boarding. I also enjoy live concerts, sporting events and travel. Finally, I also volunteer and serve on a nonprofit board at my childrens’ school.
