President & Fellows of Harvard Coll. v. Elmore

Steve Elmore and Harvard contracted to publish a book, provisionally titled In Search of Nampeyo: the Apprenticeship of a Great Hopi Artist. In theory, it was a good deal for both parties. Harvard stood to benefit because the book would discuss pottery in Harvard's Keam collection, which is held in Harvard's Peabody Museum, and potentially attribute much of the artifacts to a renowned Hopi artist, Nampeyo. Mr. Elmore also stood to benefit, because the book would build his credibility as an author and dealer of Hopi pottery. The deal, however, did not go according to plan. After Mr. Elmore published his book, Harvard filed suit alleging, among other claims, that Mr. Elmore infringed on Harvard's copyright for Historic Hopi Ceramics. The Court granted Mr. Elmore's Motion for Partial Summary Judgment for the images based on the Historic Hopi Ceramics photographs, because Mr. Elmore's images are not substantially similar to the protected aspects of the Historic Hopi Ceramics photographs. Consequently, the Court denied Harvard's Cross-Motion for Partial Summary Judgment that Elmore is Liable for Copyright Infringement.

Amparan v. Lake Powell Car Rental Cos.

Edmundo Amparan and Kimberly L. Amparan (the "Amparans") appealed from the district court's grant of summary judgment in favor of Lake Powell Car Rental Companies ("Lake Powell") on the Amparans' claims for negligent entrustment and loss of consortium. The claims arose from a vehicle accident involving a motorcycle operated by Mr. Amparan and a Ford Mustang rented by Lake Powell to Denizcan Karadeniz and operated by Mevlut Berkay Demir. Mr. Karadeniz and Mr. Demir are both Turkish nationals who were under the age of twenty-five at the time of the accident. Because the Amparans failed to come forward with evidence from which the jury could find an essential element of their claim for negligent entrustment, the Tenth Circuit Court of Appeals affirmed.
