Federal Insurance Co. v. Total Transportation
In a freight loss case involving high-value computer components, a Silicon Valley jury in San Jose agreed with the trucker's defense set forth in the shipment's Uniform Straight Bill of Lading and the limitation of liability provisions of the National Motor Freight Classification. The verdict of the jury for the trucker limited its liability to the release value of the lost components instead of the sales price as argued by the shipper's cargo insurer, saving the trucker from substantial liability.
Stevens v. Amador Worldwide Moving & Storage
An executive with a Silicon Valley electronics company was promoted and transferred from LA to San Jose. However, her household goods were stolen, along with the trailer in which they were packed. Neither her possessions nor the trailer, were ever recovered. The insurer of the shipment offered her pennies on the dollar based on the release rate in the household goods bill of lading. However, she recovered more than $100,000 because I was able to show that the release rate did not apply to her shipment because she was never given the option to purchase cargo insurance. Stevens v. Please describe a case in the last year or two where you made a big difference.
Recently I successfully represented Sonoma County and Monterey County, shippers in so-called ""Double Payment Cases,"" where the shippers were being sued by Collection Agencies for payment of freight charges which the shippers all had previously paid to a truck freight broker, but the broker had not paid to the truckers. Both cases were dismissed with no payment by the shippers to the Collection Agencies saving the shippers more than $10,000.00 in freight charges.
