Please describe a case in the last year or two where you made a big difference.

Client, a former professional baseball player and native of the Dominican Republic, was charged with Possession with Intent to Distribute a Class B Drug (Crack Cocaine), Disorderly Conduct, Resisting Arrest, and Conspiracy. Police alleged that Client was part of a drug deal with another man. Client's friend was driving the car, and police observed what they believed to be a drug deal when Client's friend entered an apartment and quickly got back in the car. When the police were pulling over the car, they observed Client's friend trying to swallow several bags of cocaine. The police further alleged that Client was flailing around, and almost hit a detective, while screaming and creating a disturbance and trying to prevent the detective from making an arrest. Client hired Attorney Joseph B Simons to fight for him. Client was concerned not just with the potential for jail time, but also about immigration consequences, as he is not a citizen. A deportation would be devastating, as Client has a wife and kids in America and has established a life here. After a highly contested trial, Attorney Simons effectively cross examined two detectives and was able to establish that no drugs were found on Client. Attorney Simons also demonstrated that Client had no idea that the detectives were police, as they were in plain clothes and drove in an unmarked car. At the end of the trial, Client was acquitted of all charges. Client maintained his freedom, and was able to remain in the United States with his family.

How did you build a successful practice?

By getting incredible results for clients and treating people right. No one can guarantee a win on any specific case. I have, however, been fortunate enough to beat cases that other lawyers thought were unwinnable. But also, I treat each client with respect; I understand that in every case I handle, the results affect real people. People with families, careers, and reputations. Criminal charges can ruin lives, and I never take a case lightly, no matter what the charges.

What should clients look for in a lawyer?

If I were hiring a criminal defense attorney, I would want someone who has a history of excellent results. It is also important to find an attorney who you connect with. Criminal cases can stretch on for several months, or even years. You want to make sure that you like the person you're working with.

How important is local knowledge to the success of your cases?

Honestly, not that important. If you're looking to fight a case, you want the best lawyer you can get. I've been in over 70 courts, and have secured dismissals and not guilty verdicts in courts I've only been in once. Having a "local" attorney can actually backfire in some cases. Consider that if a lawyer is in the same courthouse every day, the judge is probably immune to hearing the same arguments day after day, as compared to a fresh, compassionate argument from a Boston lawyer. In addition, if local lawyers are always making deals with the prosecutor, it could be a two-way street; the local defense attorney may give up ground on one case to gain on another. When I'm in court, I have no loyalties to anyone except my client.

What information can you provide in a free phone consultation?

My personality shines through. You'll get enough of a feel on an initial consultation to know whether you want to work with me or not. I can give you some basic information about the charges and the court. And I (almost) always quote a fee on the phone.

What information do you need in a free phone consultation?

In order to give any meaningful information, and a quote, ideally I'd like to see a copy of the criminal complaint and police report by fax of email prior to the call.

What differentiates you from other lawyers in your community?

There are a number of very good attorneys in Massachusetts. That being said, I'm confident that my clients receive the best possible representation.

What is the most rewarding aspect of your job?

I love going to trial and hearing those two special words: ""Not Guilty.""

What are your other interests in addition to law?

I like to shoot baskets, go swimming, and play guitar.

I've served as an elected town meeting member, served on my kids' preschool advisory committee, and other community activities.
