As an attorney, Kenneth’s primary focus has been Workers’ Compensation and criminal law. He was a deputy prosecuting attorney in Gillette, Campbell County, Wyoming before opening Plains Law Offices, LLP with his wife, Erin Mercer, in 2004. Kenneth and Erin ran Plains Law Offices, LLP together until 2011, when Kenneth was elected as county and prosecuting attorney for Johnson County, Wyoming. In 2015, Kenneth went back into private practice focusing on workers' compensation law.

Montoya v. Wy. Workers' Compensation
Injured worker had a non-work related auto accident several years prior to his work injury that resulted in him suffering from migraines. He slipped and fell at work striking his head and soon suffered additional and increased headaches and memory loss. It was ultimately determined that the worker suffered from a traumatic brain injury. The Division denied benefits claiming his condition was preexisting. The Supreme Court reversed this decision stating there was overwhelming evidence that the worker's fall aggravated his preexisting condition.
Straube v. Wy. Workers' Compensation
Employee suffer an injury to his knee which substantially worsened over time. Division denied benefits claiming intervening circumstances. Supreme Court reversed and granted benefits.
