Attorney Kim Parker successfully represented her client in an appeal against a judgment from the Circuit Court for Baltimore County in a civil action initiated by landlord Peter M. Ferraro for unpaid rent and property damages. The trial court initially entered a default judgment against the Client, claiming she failed to respond to Ferraro's complaint. However, Davis had submitted a document titled "Late Defense" within the prescribed time, which included a certificate of service and served as her answer to the complaint. The appellate court found that this filing was timely and constituted a sufficient response under Maryland law. It ruled that the circuit court erred in entering a default order against the Client, denying her motion to vacate, and subsequently granting Ferraro a default judgment. The appellate court emphasized the importance of focusing on the substance of legal filings rather than their labels. It reversed the circuit court’s judgment and remanded the case for further proceedings, ordering Ferraro to pay the costs associated with the appeal.
