About Lee

Lee Bergstein was a city and state prosecutor for almost nine years before starting Bergstein Flynn. During his time at the New York State Office of the Attorney General (OAG), Lee was assigned to the Criminal Enforcement and Financial Crimes Bureau where he led complex white collar investigations including:
 
Fraudulent Offering of Securities
Ponzi schemes
Stock market manipulation
Residential mortgage fraud
Whistleblower investigations
Insurance Fraud
 
While at the OAG, Lee worked closely with other bureaus to tackle complex issues which required an intimate understanding of both the civil and criminal white collar landscape.  Lee was an early member of a real estate task force which identified and investigated developers, landlords, attorneys, title companies and other individuals or entities who conspired to defraud banks, government entities and unsuspecting homeowners. Lee also was a member of the trial team which prosecuted and convicted a network of individuals who defrauded prospective nurses.  Prior to his time at the Attorney General, Lee worked for over six years at the Queens County District Attorney’s Office where he handled the prosecution of countless violent and nonviolent crimes including:

Lee has tried dozens of criminal cases to verdict and negotiated hundreds to plea settlement.  In addition to his litigation experience, Lee has taught and tutored prospective lawyers for many years.  From 2011 through 2014, Lee served as an Adjunct Professor of Law for Trial Advocacy at the Hofstra University School of Law.  More recently, Lee served as a guest instructor of Trial Advocacy at Columbia Law School.  Lee has also tutored law students on Evidence, Criminal Law, Legal Writing and Torts.  Lee graduated from Brooklyn Law School where he earned his Juris Doctorate.  He studied Television and Film at Syracuse University, where he received his Bachelor of Arts degree.  Lee is committed to superb customer service, diligent attention to detail and optimizing technology for his clients’ benefit both inside and outside of the courtroom.

Please describe a case in the last year or two where you made a big difference.

I was referred a cross-complaint where it was clear from my initial reading of the facts that my client did not do anything wrong. Instead of accepting an ACD (the typical offer in such a case) I pushed the prosecutor to meet with my client, knowing that such a meeting would result in a dismissal. It did. It also resulted in the District Attorney taking a closer look at the actions of the cross-complainant to ensure that justice was done.

How did you build a successful practice?

We pride ourselves on taking the time to understand what our client wants. Once we know our client's goals, we look to harness our experience, our innovative approach to the practice of law and our zealous advocacy to arrive at that result.

What should clients look for in a lawyer?

Transparency and experience.

How important is local knowledge to the success of your cases?

Clients should choose someone who is experienced handling New York cases. Borough by borough experience is less important than experience in the relevant practice area.

What information can you provide in a free phone consultation?

I provide the opportunity for the prospective client to explain his/her situation to me and to explain what his/her goals are. I give an initial assessment of his/her situation and those goals. I then provide a prospective blueprint for how my representation would seek to meet those goals and estimate how much that representation would cost.

What information do you need in a free phone consultation?

The full facts of a matter: dates, locations and any pending or prospective charges, if the matter is criminal. In a real estate matter, I need all the facts relating to the home/condo/coop sale or purchase.
