Please describe a case(s) in the last year or two where you made a big difference.
One of our two most significant cases from the last year was a case where the City of Upland attempted to bring criminal charges against a homeowner who would not water his lawn because of the drought. We refused to accept any plea and insisted on a trial. Eventually the City gave up and simply dismissed after getting news coverage across the nation for over a year on their really questionable decision to bring a criminal prosecution for this.
The other very important case we had last year was a Freedom of Information Act Case where we twice got local Judges reversed. The opinion ended up getting published and the case made a big splash in this area of law and resulted in several articles being written about. The case stands for the principle that a government body that violates the California Public Records Act (the State version of the FOIA) is going to be liable for attorney fees even if the attorney seeking the fees is also the one seeking the records.
Below are the links to the opinions and also to three articles about the case, some of which offer some very misleading and incorrect speculation about what was really going on.
How did you build a successful practice?
By putting my client's first. So frequently, the best advice to give to a client does not involve them hiring you. Whereas most attorneys believe that they need to get retained when the potential client is in front of them, by always giving the client advice that places them first, even when that results in us not getting hired, we expand our window of opportunity to get future business because sooner or later, everyone needs an good and honest lawyer.
What should clients look for in a lawyer?
Someone with a good local reputation, experience, and whom is available to give their matter the attention it needs.
How important is local knowledge to the success of your cases?
It is tremendous. In a smaller community like the INland Empire, we all live by our reputations, including the Judges and defense counsel. Knowing the Judges and defense counsel and the environment of every court room, every department and every firm, is a tremendous advantage over outsider attorneys whom are not familiar. We have several attorneys with 40 years experience and our connections with the local legal community give us a huge home court advantage when going up against outsiders.
What information can you provide in a free phone consultation?
In my consultations, whether by phone or in-person, I educate the potential client as much as they choose about the substantive law as well as the procedural law that applies to their matter. I also try to help them understand their primary choices about different ways they might proceeds and the pros and cons of each route.
What information do you need in a free phone consultation?
In order to give helpful information, I need an accurate timeline of the relevant facts. Where there are relevant records, e.g., police reports, medical records, insurance policies, etc., it is also very helpful to have those available.
What differentiates you from other lawyers in your community?
Competency and ethics. Particularly in the Inland Empire, the standards are very low. There are many incompetent attorneys out there changing their practice areas as the wind blows. And many of the better attorneys whom only practice in a single practice area have compromised ethics and exploit their clients by placing the attorney's fee over what is in their client's best interests. By always placing the client first, we expand our window of opportunity. This is in part because we practice in most areas of consumer law. Whereas an office that only practices in family law will lose their window of opportunity if they advise their potential client in a manner that does not result in them getting retained, by giving the potential client advice that places them first, my window of opportunity for future business skyrockets. If in the future they, or a close friend or family member, needs an attorney for a family matter, a workers comp matter, a criminal matter, an insurance, business or real estate matter, etc., they will know a local, competent lawyer to refer them to who will always put their client's first by giving the best advice for the client.
What is the most rewarding aspect of your job?
This firm exists to help people and helps several hundred people every year. The most rewarding part of my job is the gratitude that our client's feel when we are able to successfully take a matter in their lives that had become a huge problem and burden and resolve it for them.
What are your other interests in addition to law?
I am the publisher of 909 Magazine, a local editorial magazine. I also have a world class autograph and document collection containing over 15,000 items including handwritten and important documents from every president and thousands of other important persons ranging from Ferdinand & Isabella to Napoleon. I also spend much time with my three sons frequently coaching their soccer teams.
Are you involved in your community?
I have served on the Board of our Temple and have hosted many events over the years for various causes and candidates. Through my magazine, we also exert some influence by providing editorial space for various causes or candidates for local office. We are presently organizing a 5K Run in conjunction with some local charities to raise money for the San Bernardino terror victims.
