In 1987, Marc A. Taxman began his legal career as a research and writing clerk at Anesi, Ozmon, Rodin, Novak & Kohen, Ltd. while a law student in Chicago.  Marc successfully made the transition to lawyer and has established an impressive record as a trial attorney.  Marc has been nominated by his peers to be included for the honor and distinction as one of Illinois' Leading Lawyers in personal injury law.

In 1998, he won a landmark case before the Illinois Supreme Court that provided greater protection for men and women forced to do their jobs under dangerous conditions.  The case began in 1995 with a trial involving a teamster who was not provided a safe environment to perform his job; after a trial the jury awarded more than $1.1 million.

Elected a partner in 1999, Marc continues to win millions of dollars in verdicts and settlements.  His casework continues to set precedents in the field of personal injury law.  Marc chairs our firm's new case review committee which delineates responsibility and plans strategy for successfully prosecuting our cases.

Marc feels privileged when clients entrust him to speak and act on their behalf.  He accepts that responsibility by devoting himself to their cases and investigating the evidence with discipline and creativity. That attention to detail, along with thorough research and preparation, equips him with the best proof possible to establish that his clients are entitled to justice.

Marc's recent verdict and settlement highlights, all since 2000, include:

  • $20,937,000 verdict for an ironworker whose arm was severed by a 550 lb. steel beam falling from a crane on a construction site.
  • $18,000,000 medical malpractice settlement for a family whose child was injured during labor and delivery.
  • Substantial undisclosed settlement in the traumatic sexual assault of a 79-year-old nursing home resident.
  • $12,434,000 record settlement for an ironworker and his wife after the worker suffered brain injury from a fall.
  • $2,756,441.82 record jury verdict in a medical malpractice case for a girl who suffered an injury to her middle finger at a Hospital on the day of her birth following a C-section delivery.
  • $1,950,000 medical malpractice settlement for the wife and three children of a cancer patient who died due to the failure to diagnose and treat the condition.
  • $1,750,000 settlement for an ironworker who suffered a severe wrist fracture when he fell from a beam during construction.
  • $1,364,000 verdict for an ironworker who injured his knee and aggravated a pre-existing arthritic condition at a building in downtown Chicago.
  • $1,468,750 settlement for an ironworker who fell 8 feet and suffered bi-lateral wrist fractures that aggravated pre-existing arthritis.

Marc frequently speaks before the Illinois Trial Lawyers Association, Illinois State Bar Association and the Chicago Bar Association on such topics as evidence, trial practice, medical malpractice, construction negligence, premises liability and other areas pertaining to personal injury law.  He has also published a chapter in the Illinois Institute for Continuing Legal Education as well as course materials and papers presented at speaking engagements.  Marc also serves as an investigator and conducts hearings for the Chicago Bar Association's prestigious Judicial Evaluation Committee.

"People seek my help because they have been hurt as a result of someone failing to live up to their responsibilities.  It is my job to help put the pieces together.  I love what I do and nothing gives me greater satisfaction than successfully prosecuting a case on behalf of my clients."

Marc's extensive experience as a trial lawyer and excellent results have earned him the following recognition:

  • Illinois Super Lawyer Top 5% of Attorneys in Illinois.
  • Illinois Leading Lawyers recommended by peer Attorneys.
  • Top Lawyers Personal Injury Lawyers 2005 as Published in Crain's Chicago Business.

The Ups and Downs of the Program for Voluntarily Reclassifying Your Workers
Whether a worker is properly classified as an employee or as an independent contractor depends upon the facts and circumstances. Generally, the determination is made under common law tests considering the right to control and direct the individual performing services. However, in some factual situations, the determination of the proper worker classification status may not be clear.
The IRS Says I Owe More Tax and We Couldn’t Reach an Agreement. Now What?
When a taxpayer receives a notice from the IRS proposing an additional assessment of tax, the taxpayer can often work administratively with the IRS to resolve the dispute. However, many times, the taxpayer and IRS are not able to come to an agreement. In those instances, there are four different forums which can be utilized to litigate a Federal civil tax case: the United States Tax Court, United States District Courts, the United States Court of Federal Claims, and United States Bankruptcy Courts.
QBI Guidance Issued; Safe Harbor Provided for Real Estate Enterprises
As we detailed in Section 199A: New 20% Pass-Through Deduction1, the Tax Cuts and Jobs Act of 2017 created new Internal Revenue Code §199A-providing a significant tax break to flow-through entities and structures. Subject to certain limitations, many eligible taxpayers (excluding C corporations) may deduct up to 20% of the “qualified business income” (QBI). Significantly, even qualified real estate businesses may benefit from the deduction.2
