Mark is a trial attorney and founder of Mark Casto Personal Injury Law Firm where he represents individuals or families who have suffered an injury or the loss of a loved one. He has civil litigation experience in the areas of motor carrier/transportation liability (tractor-trailer wrecks), motor vehicle accidents, product liability, premises liability, medical malpractice, nursing home abuse, employment discrimination, and insurance bad faith.

Garnering Courtroom Experience as a Former Prosecutor
Mark’s career began at the Office of District Attorney where he prosecuted numerous cases and was specifically assigned to prosecute child victim crimes. Mark acted as lead prosecutor in over 50 jury trials in Superior Courts of Georgia with an astonishing success rate.

Mark was a sole practitioner attorney for almost five years. In his sole practice, Mark gained extensive experience in representing the injured victim due to others' neglect. Mark, also, handled numerous criminal defense cases including the successful trial defense of an individual accused of murder. Additionally, Mark handled contested and complex domestic/divorce cases.

All in all, Mark has developed a great skill in the presentation of his cases at trial.

The History of Mark Casto Personal Injury Law Firm
In January 2006, Mark was a founding partner of The Law Firm of Bennett and Casto. Mark’s practice focus on injured persons expanded to include personal injury, workers compensation, Nursing Home Neglect and Abuse, medical malpractice and employment discrimination claims.

Ten years later, in April 2016, Mark founded Mark Casto Personal Injury Law Firm on the premise of providing superior service to his clients. Believing that it is hypocritical to sue medical doctors when also asking these doctors to care for his personal injury and worker’s compensation clients, Mark will not file a claim against a doctor for medical malpractice, but rather the hospital or other negligent parties.

Successful Appellate Practice
Mark also has handled numerous cases on appeal. He has argued in person before the Georgia Supreme Court and Georgia Court of Appeals. He has never lost an appeal in which he was allowed to argue in person before the Appellate Judges.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

1st case: This was a car accident case where the collision involved my client and a law enforcement patrol vehicle. The Georgia State patrol cited my client for Failing to yield the right of way and Failing to Yield to an Emergency Motor Vehicle and the said he was at-fault in causing the wreck. After 3 other lawyers rejected the case, I took it on to investigate the claim because I felt that there were several inconsistences in the report and I believed the client. I was able to determine and prove that the deputy driving the other vehicle was in fact at-fault in causing the wreck and that the Georgia State patrol had incorrectly investigated the wreck. I got my clients citations dismissed and we went on to settle his personal injury claim for $105,000.2nd case - A young lady was attacked by a vicious dog and received severe wounds to her face, head and upper body. Unfortunately she did not have health insurance. However, since I live in Columbus, Georgia and have many great personal relationships with local physicians in town, I was able to insure that received all of the medial treatment that she needed to heal the physical wounds, obtain psychology stress and anxiety counseling and treat the scars to limit the disfigurement to her face. The case is not resolved yet, but I'm very thankful that we were able to get her the healthcare that she needed; however, otherwise she likely would not have gotten.

How did you build a successful practice?

I've built my practice based on the Golden Rule - "Do unto others as you would have them do unto you." This means we strive everyday to put forth quality and dedicated work for each client while doing so with the highest of client/customer service such as good and regular communication, polite and courteous treatment, patience and taking the time to fully explain the legal situation presented to the client. In turn, clients and former clients have become our biggest source of referrals generating new business.

What should clients look for in a lawyer?

In a personal injury case, clients should look for someone that has experience and recognized expertise in the field, someone that is involved in the community because that attorney will have an investment in the client rather than some distant concern where you client is just a name or number. Finally, don't ever hire a lawyer until you actually look in the attorney's (not just some "case manager") eyes and speak to them. I you don't like them or get a sense of trust, then don't hire them.

How important is local knowledge to the success of your cases?

Having local knowledge is a great advantage of other attorneys from Atlanta or elsewhere. It's important to know the community and the landscape. When a client says I was traveling on a certain road, an out of town lawyer has no idea where that is. However, I do and I've likely traveled on that very same road. I will know where the blind spots are or where the sharp turn is, etc. Also, being local is advantage because I know the local police officers who generally are the investigators of the car wreck the client was in. I can speak to them and learn things about the event that aren't necessarily included in the report. These officers may not give the same courtesy to an attorney that they do not know.

The general process of a claim. The general length of a claim. Our fee structure. Our internal case handling process and a general opinion on the liability of case. It is impossible to give an opinion of the value of a case until a more thorough investigation has been completed.

Information that I need at consultation is: what caused the injury (car wreck/fall/animal attack/truck/etc), when did it happen, where (county and State), and what are the injuries.
