Ms. McIlvain concentrates her practice on complex commercial litigation and on defamation and media law issues. Her practice includes substantial litigation in the securities area including a current representation of an officer of a defunct publicly-traded company in a series of class action securities cases.Experience: In the last twenty years, Ms. McIlvain has litigated a wide variety of cases in federal and state courts throughout the country including defamation suits, software licensing and implementation claims, attorney malpractice suits, civil rights and employment matters, professional sports antitrust cases, RICO claims and constitutional challenges under both the U.S. and Pennsylvania Constitutions.
Representative Matters:
Represent newspapers and reporters in various defamation suits.
Represent a bankruptcy Trustee in adversary case against the directors and officers of a now bankrupt independent television station.
Represent a former CFO of a now bankrupt specialty finance company in a shareholder derivative suit, a suit by bondholders and a suit by the Trustee in bankruptcy.
Represented a former CFO of a publicly-traded company in an investigation conducted by the SEC.
Represented a major law firm and three of its attorneys in a legal malpractice action resulting in a beneficial settlement.
Obtained defense verdict after four-week jury trial on claims under the Civil Rights Acts of 1866 and 1871 and state law.
