Plaintiff: Attorney for the plaintiff-appellants, Daniel and Catrina Jerden. The couple had brought a medical negligent claim against the defendant-appellee, Dr. Paul G. Amstutz. The defendant had mistakenly diagnosed Mr. Jerden with a brain tumor. Invasive and unwarranted neurosurgery was conducted before a correct diagnosis of multiple sclerosis was made. A jury trial returned a verdict in favor of the defendant and the Jerden's subsequently appealed. Based on newly discovered evidence the appeals court agreed that the trial court had erred in their decision. The judgement was reversed and remanded for further proceedings.
