O’Meara is an Illinois native and graduate of The John Marshall Law School who has focused much of his career on criminal cases in and around the greater Chicago area. DUI

Practice Area: DUI and DWI Outcome: Not Guilty Description: People of IL. v. M.B. – In Cook County, the client was facing a second DUI charge with a breathalyzer result over double the legal limit. Result: Mr. O’Meara argued that the arrest was illegal and called the arresting Sergeant to the stand and questioned him about how the arrest was handled. After the contested hearing, the judge agreed with Mr. O’Meara and threw out all the evidence based on an illegal arrest. Thus, the court granted the motion to quash and the State’s Attorney was forced to dismiss the case.

Battery

Practice Area: Criminal defense Outcome: Not Guilty Description: People v. L.N. and A.S. – In Cook County, both clients were charged with battery causing bodily harm after allegedly punching, kicking and beating a person with a lead pipe. The alleged victim sustained severe facial and head injuries that required numerous stitches as well as major dental work to replace several teeth. Neither of Mr. O’Meara’s client’s suffered an injury. An independent eyewitness testified that she saw the client’s beat the alleged victim without being provoked. Result: After a bench trial that included 7 witnesses, the judge found Mr. O’Meara’s clients not guilty of the charges based on self defense.
