Please describe a case in the last year or two where you made a big difference.

Carolyn Hoffman v. Leisure Village, case 02-682 CA in the Nineteenth Judicial Circuit. One of my clients had a small Maltese who was company to her and helped ease the pain of her chronic depression. The park had a strict 'No Pets' policy. I researched and found that she could make a Request for Reasonable Accommodations and send it together with a Doctor's Certificate, to keep the dog in the Park, as her condition was a recognized disability under the Fair Housing Acts of both the State and Federal governments. This request resulted in a Motion for Contempt by the Park's Attorney, as Hoffman had signed a stipulated judgment order arising out of the above suit, dormant for nine years, where her former Maltese was not to be replaced after he had died. However, I had won this suit based upon Florida Association Law which forbids Associations from selectively enforcing their rules - there were other animals in the Park. The Park also had to pay her attorneys fees and was not happy. Her second case differed from the first in that the first was not brought under the Fair Housing Act but was based upon Association Law. Meanwhile, I filed a complaint for her with the Florida Commission on Human Relations, which issued an opinion foursquare in my client's favor. This Commission ruling was ignored by the trial judge. I then persuaded a national Handicapped Rights law firm to take her case to a federal level. When this case was dismissed for lack of jurisdiction (erroneously, I believe), I made an election, for the client to have her case brought by the Attorney General's Office of the State of Florida, which was an option under the State act. The AG's office took over responsibility for the case and lost in the trial court on the basis of res judicata.

I suggested and urged the AG's office to take the case to the 4th DCA on the grounds that a cause which is brought under the Fair Housing Act is a case of new and original jurisdiction. The 4th DCA ruled firmly in favor of my client and reversed, with damages to be paid to the Plaintiff. As a local attorney and a 'first responder,' who supported my client throughout, I believe that I had made quite a difference in the outcome. The case is still pending in the Circuit Court for assessment of my client's damages.
