MURPHY V. GOLDEN POULTRY CO., INC
Appellant: Attorney for the appellant, Patricia Murphy. Murphy was an employee of the Golden Poultry Company, Inc. During the original trial, Murphy claimed that she was entitled to workmen's compensation for an injury sustained while employed with the appellee. A trial court found that she had not sustained a permanent disability and that she had been fairly compensated for the three weeks she was temporarily disabled. Murphy did not appeal, but later would file a motion for relief judgement as a reexamination of her knee found that she would need surgery to remove scar tissue. Her motion was denied and Murphy appealed. Upon review of the case the appeals court found that the original court did not err in their judgement. Decision is affirmed.
"Case in which the attorney (Peter M. Neil) was a Defendant in a case in which a Plaintiff alleging tortious interference with contract, trespass to personal property, conversion, trespass to real property, civil conspiracy, and the tort of outrage. The case was dismissed and on Supreme Court of Alabama Appeal, which found no basis in the concession of counsel at the May 30, 2008, hearing that would foreclose further proceedings against the Neils. The trial court's sua sponte dismissal of Smith's claims against the Neils. Therefore it was reversed. "
