Please describe a case in the last year or two where you made a big difference.
In Johnson v. State ex rel WYDOT, 2020 WY 19 & 2021 WY 116, Wyoming Supreme Court agreed that Wyoming’s implied consent law created a statutory and substantive due process right to an independent chemical test in a DUI or implied consent case. In Hardman v. State, 2020 WY 11, Wyoming Supreme Court agreed with me that a chemical testing laboratory must prove strict compliance with approved scientific methods used in DUI cases or must prove compliance with traditional rules or evidence.
How did you build a successful practice?
I have focused on criminal practice for years and I have garnered the respect of the courts and prior clients that a great deal of my success is due to word of mouth.
What should clients look for in a lawyer?
Given the breadth of practice areas, a client should try to find an attorney who is competent in the particularly area of law involved with the client’s issue.
How important is local knowledge to the success of your cases?
My criminal law and DUI practice includes the entire State of Wyoming. I have found that most judges know who I am whether I have met them before or not. I have won jury trials all over the State of Wyoming, even though I may not be known by local jurors.
What information can you provide in a free phone consultation?
I have created a form that I provide to potential clients before a phone conference, which has them provide me with information so I am prepared to answers questions relating to legal issues that may apply to their defense, which includes medical issues that create valid defenses.
What information do you need in a free phone consultation?
I have potential client’s complete a written intake form, which they fill in the blanks, save, and then return to me prior to my free initial consultation.
What differentiates you from other lawyers in your community?
I am the only attorney in Wyoming that specializes in DUI and implied consent cases. I have taught continuing legal education (CLE) classes concerning DUI and implied consent laws for twenty (20) -years. I usually speak at least once a year for the Wyoming Trial Lawyers Association (WTLA). I have also provided lecturers for the National College of DUI Defense (NCDD), DUI Defense Lawyers Association (DUIDLA), the Wyoming State Bar, the North Carolina Advocates for Justice (NCAJ), and for the institute for continuing legal education associated with the Georgia State Bar (ICLEG). What is the most rewarding aspect of your job?
Helping people who are falsely accused of crimes and helping to mitigate the potential punishment a person may face in a criminal case involving poor choices made by my client.
What are your other interests in addition to law?
I like to travel, play golf, do jigsaw puzzles and Sudoku.
