Upon graduation from the University of Florida's Law School, Mr. Atwater moved to Denver and practiced as a Certified Public Accountant in the Tax Department of the international accounting firm of Price Waterhouse and Company.  Mr. Atwater left Price Waterhouse and Company in 1978 to open his CPA and law practices in Winter Park, Colorado.  In 1982 he acquired Fraser Valley Realty, Inc., a Colorado real estate brokerage which he continues to operate today.  For a time he owned and operated Alpine Title Insurance Agency as a TICOR title insurance agent.  Mr. Atwater now limits his activities to the practice of law and special situation real estate brokerage opportunities.  His law practice emphasizes the planning and formation of tax-sensitive entities including for-profit, non-profit and tax-exempt entitites, the design and implementation of tax-sensitive transactions, estate and probate planning as well as sophisticated real estate transactions and real estate development.  Mr. Atwater has participated in Atwater & Herren, Attorneys at Law, LLC since its formation in June of 2003 through his professional corporation, Randolph S. Atwater, Attorneys at Law, P.C.

SAMPLE LEGAL CASES

Does Getting a Document Notarized Make It "Legal"?
The public's perception of what a notary does and what notarization accomplishes is often incorrect. This is particularly the case when a person brings a document to a notary public to be notarized, thinking that the notarization will in some way "legalize" the document or make it "official." Unmarried? You Are Not Alone, But You Still Need a Plan
Did you know that in many instances, it is even more important that a single person have a well-coordinated estate plan, than a married couple. This is because the default laws governing estates often work poorly for people without a spouse and may not adequately provide for a significant other or unmarried partner. Having a cohesive and well-drafted estate plan will ensure that you protect and provide for those you truly care about upon your death. Learn more here.
When an Adult Needs a Guardian of Property
There are two types of guardianships: a guardianship of the person and a guardianship of the property (also known as a guardianship of the estate or a conservatorship). A guardian of the person is responsible for the ward’s physical safety and well-being. A guardian of the property is responsible for the ward’s money and assets. Learn more here.
