State v. R.D.
In what is believed to be the first time in State of New Jersey, the State Expungement Statute has been applied to grant relief for a decedent. On January 28, 2011, Superior Court Judge Stephen B. Rubin entered an Order in Flemington, New Jersey, granting the Expungement of various arrests for disorderly persons offenses and an ordinance violation in the case of State v. R.D. The decedent met with his untimely death by suicide last year while complaints charging him with alleged violations of Obstructing the Administration of Law and a local Township Ordinance for remaining in a public park after dark were pending. Previously, the defendant had completed a Conditional Discharge for a marijuana offense, and an earlier charge of Obstructing the Administration of Law was dismissed.
