Law Practice - Mr. Babcock is a principal in the Salt Lake City law firm of Babcock Scott & Babcock. His practice is concentrated on construction contract claims and litigation in both public and private proceedings. In addition to his legal degree, Mr. Babcock is a civil engineer. He has represented owners, architects and engineers, general contractors, subcontractors and suppliers in the Intermountain West.
Industry and In-House Seminars - In addition to an active litigation practice, Mr. Babcock is an experienced public speaker and author in the construction field covering topics including project scheduling and construction claims, arbitration of construction disputes, differing site conditions, mechanic's lien and bond law, and pitfalls of specification writing. He has spoken on behalf of numerous organizations including the Associated General Contractors, Associated Builders and Contractors, the Construction Specifications Institute, the Utah Surety Association, the American Arbitration Association, the Intermountain Utility Contractors Association, the Small Business Administration, and the American Society of Civil Engineers. He has also presented in-house training seminars for clients, tailored to their needs.
Construction Background - The son of a professional engineer, Mr. Babcock has long been involved with construction. He worked for a materials testing and inspection laboratory in his native southern California as well as a Utah construction company.
Education - Mr. Babcock received a Bachelor of Science Degree of Civil Engineering from the Brigham Young University, graduating magna cum laude. He received his Juris Doctor degree, graduating cum laude, from the J. Reuben Clark Law School of the Brigham Young University, Provo, Utah.
Professional Association Involvement - Mr. Babcock is admitted to practice before the Supreme Court of Utah, the United States District Court for Utah, the United States Court of Appeals for the Ninth and Tenth Circuits and the Federal Claims Court. A member of the Forum Committee on the Construction Industry and the Public Contract Law Section of the American Bar Association, Mr. Babcock has served as the chairman of the Public Contract Law Section for the State of Utah. He also helped create and has served as President of the Construction Law Section of the Utah State Bar.
He is a member of the Construction Industry Panel of Arbitrators of the American Arbitration Association including the panel for Large, Complex Cases. He has served as an arbitrator of many construction disputes. He was a founding member of and presently serves on the Utah Advisory Panel for the American Arbitration Association. He is also a member of the AAA Mediation Panel and has mediated a number of matters.
Mr. Babcock is also a member of the national and state organizations of the American Society of Civil Engineers, the National Society of Professional Engineers and the Construction Specifications Institute. He has served on the National Membership Committee for the National Society of Professional Engineers. He is a member of the Associated General Contractors, the Associated Builders and Contractors, the American Concrete Institute, the Construction Specification Institute, the Intermountain Utility Contractors Association, the Professionals for Construction Contractors Council of Utah, the Construction Financial Managers Association and the Utah Surety Association.
In an effort to further the goals of the construction industry, Mr. Babcock has served and continues to serve as an officer and on various committees in several trade associations. He served as president of the Utah Society of Professional Engineers, as treasurer and board member of the Utah Chapter of Associated Builders and Contractors and on the suppliers committee of the Utah Chapter of the Associated General Contractors. He presently serves on the Associated General Contractors' legal advisory committee having served as its chairman during 1988. He also serves as well as the chapter attorney for both the Intermountain Utility Contractors Association and the Associated Builders and Contractors. Mr. Babcock also worked on two committees helping prepare new construction contract documents- one for the Utah State Division of Facilities Construction and Management and the other for the Utah Chapter of the American Public Works Association for use by the public entities in Utah.
Mr. Babcock is active politically serving on the legislative committees for the Associated General Contractors, the Associated Builders and Contractors, and the Intermountain Utility Contractors Association. He has both drafted legislation on behalf of the construction industry and lobbied for its passage. He is also a member of the Utah Governor's Club and has served on several political campaign committees. In addition he has been a candidate for the Utah House of Representatives in 1990.
Mr. Babcock was honored to receive the Associated General Contractors', Utah Chapter, Service to the Industry Award in January 1989. He was also honored to receive the Outstanding Service to the Utah Construction Industry Award in February, 1994, from the Utah Chapter of the Associated Builders and Contractors.
Mr. Babcock served for several years on the Board of Directors of the Apartment Association of Utah and served as the President in 1983.
