Ruben A. Montoya, Esq., the founding and managing attorney of Montoya Law, who specializes in workers’ compensation, personal injury and employment law respectively.

Mr. Montoya received Juris Doctor degree from Trinity Law after earning his bachelor’s degree in Political Science from University of Texas at San Antonio. During his time at as a law student, Mr. Montoya was employed as a law clerk and paralegal for one of Orange County’s premier law firms specializing in personal injury and workers’ compensation.

In early 2017, Mr. Montoya opened Montoya Law, after years as the Managing Attorney, overseeing a plethora of staff and associate attorneys, for one of Southern California’s highly respected workers’ compensation and personal injury firms. After much success at his prior firm, Mr. Montoya had a vision of his own: to open a firm where clients work directly with their actual attorney. This approach has led to much of the overwhelming success Montoya Law has had thus far.

Rodas (Deceased) v. Workers’ Compensation Appeals Board

In 2016, in an unpublished decision, Mr. Montoya was successful at the trial level for the Rodas’ family. The defendant, unhappy with the loss, appealed the decision and obtained a favorable outcome. Mr. Montoya refused to stop fighting for his client and took the case to the California Court of Appeals, in which he received a decision in favor of his client.

Please describe a case in the last year or two where you made a big difference.

In 2018 the sister of an injured worker (who would eventually become our client) came into our office asking for help. Client had been in a serious injury which had caused a traumatic brain injury. The defense was offering $2.5M. Montoya Law stated that that was not enough. We reviewed the case. Made our demand taking into consideration all expenses applicant would need in his lifetime (transportation, special van, nurse help, caretaker, gasoline, mileage, etc...). 4 months later we settled his case for $5.15M would is one of the highest settlements in the history of CA for a workers compensation claim.

How did you build a successful practice?

The key to a successful practice is always caring about your clients. Fight for them since they have trusted you to do so. No matter the size of the claim we fight for them as if they were our only client.

What should clients look for in a lawyer?

Reputation, Results, Integrity. You will be placing your health and income in the attorney, you need to make sure he will protect you.

What differentiates you from other lawyers in your community?

I like to believe that we take it personal. Montoya Law commits to the client and his interest. Our client intake is limited (once we reach a certain number we stopped taking cases) to our staff. We only take clients when we know we can provide a service we will be proud of.

What is the most rewarding aspect of your job?

Getting justice for our clients.
