  • In private practice, my extensive and varied experience enables me to contribute value to entrepreneurs, law firms, and corporate legal departments.

  • My twenty years of experience in patent law includes seven years of experience doing complex patent preparation and prosecution in demanding law firm environments, seven years as management in a leading corporate environment, and over six years in private law practice. Corporate and entrepreneurial experience prior to my career in law enables me to better understand the needs and objectives of my clients.

  • At Cognex Corporation, as Chief Patent Counsel, I was the first full-time in-house attorney at the company. Cognex is a global public company in the machine vision industry with more than $150 million annual revenue. Cognex Corporation won its law suit against Jerome Lemelson's limited partnership, and invalidated his machine vision patents that were used to extract millions in license fees from larger companies such as Ford and Motorola. Cognex was founded in 1981 by three MIT graduates. Starting in 1994, I grew the patent portfolio from two issued patents with two patents pending, to over 115 issued patents with 133 patents pending, within seven years. I worked closely with engineers to strategically identify patentable technology. I personally prepared and filed eight new patent applications per year, working directly with world-class company founders/inventors. I responded to U.S. PTO Office Actions to obtain patent allowance and issuance. I rendered patent infringement and validity opinions. I also supervised outside patent counsel, and managed litigation. Further, I provided IP counseling to upper management. I provided patent education to engineers and engineering management. I recruited, trained, and managed patent administrators and in-house patent lawyers, and managed the patent department budget. I worked closely with senior management and company personnel to further business objectives in patent portfolio development, licensing, patent enforcement, employee issues, and confidentiality agreements. I established and implemented internal strategies and policies relating to using and protecting intellectual property. I developed and managed IP protection strategies within the US and abroad.

  • Prior to joining Cognex Corporation, I was primarily involved in the preparation and prosecution of highly technical patent applications in a law firm environment full-time, while I attended law school in the evening. In particular, I prepared and prosecuted patent applications relating to computer software, computer hardware, communications, medical devices, speech recognition algorithms, semiconductor devices, signal processing, database algorithms, advanced computer systems, high-temperature superconductors, image processing, high-speed modem algorithms, medical imaging and analysis, optical devices, and computer disk storage devices. I also rendered patent infringement and patent validity opinions.

  • Prior to entering patent law, I was a co-founder of a software start-up, and was involved in various aspects of technology marketing in a corporate environment. I bring the perspectives gained through these business experiences to my practice of Strategic Patent Lawsm.

When May a Debtor in Possession (DIP) Sell or Lease Property of the Estate? a Dualistic Approach Requiring Business Justification and Balancing of the Interests of the Debtor, Creditors, and Equity Ho
In response to a $140 million judgment Hulk Hogan, known legally as Terrence Bollea, obtained against, inter alia, Gawker Media, LLC (“Gawker”) and its founder and erstwhile CEO Nicholas G.A. Denton in connection with Mr. Bollea’s allegations that Gawker damaged him by publicizing a video depicting Mr. Bollea and the wife of his friend engaged in sexual intercourse, Mr. Denton filed a chapter 11 bankruptcy case seeking to discharge his personal obligations arising from the judgment and other debts. See In re Nicholas G.A. Denton, Case No. 16-12239 (Bankr. S.D.N.Y.).
Equitable Subordination
Bankruptcy courts are special courts. They are neither Article III courts (Northern Pipeline Constr. Co. v. Marathon Pipe Line Co., 458 U.S. 50 (1982)) nor their adjuncts (Stern v. Marshall, 564 U.S. 462 (2011)), but nonetheless have inherent powers (Law v. Siegel, 134 S. Ct. 1188, 1194, 571 U.S. __ (2014)) and—pursuant to 11 U.S.C. § 105—certain equitable powers. This means that they have broad powers to order equitable remedies—such as specific performance—where no adequate remedy at law exists, to the extent not inconsistent with any other provisions of the Bankruptcy Code. See Law v. Siegel, 134 S. Ct. at 1194, 571 U.S. at __. This is the backdrop against which inequitable conduct by a creditor may lead to subordination of its claim in a bankruptcy proceeding under established, codified, equitable principles. Subordination means that a claim, by judicial decree, is lowered, in whole or part, in priority relative to its ordinary position in respect of one or more other claims.
