Plaintiff: Attorney for the plaintiff, Richard Sharnick. The action filed by the plaintiff sought to recover compensatory and punitive damages to redress an alleged violation of the plaintiff's rights to freedom from false arrest, false imprisonment and malicious prosecution. The actions are brought against the arresting officers, Dennis D'Archangelo and Detective Frank A. Podpolucha. The defendants subsequently each filed motions for a summary judgement. Upon review of the case the court looks at the motion for each officer separately. IN regards to Podpolucha, the court found that he was entitled to qualified immunity from the claims of false arrest and malicious prosecution. Therefore his motion for summary judgement was granted. IN regards to Officer D'Archangelo the court finds that while weak, the plaintiff does have cause to make his case for excessive force. There for D'Archangelo's motion for summary judgment is denied.
Attorney for the Plaintiff in a Civil Rights case regarding excessive force by an officer (Defendant). The officer, son of the Chief of Police in Meridian, was accused of pushing a handcuffed prison back in a holding cell, causing him to hit his head against a concrete bench. Said Defendant left the man with a fractured skull and never called for medical help. The Defendant was placed on administrative leave and resigned. He was indicted and sentenced to 14 months in prison for using unreasonable force on a prisoner and obstructing justice in an effort to cover up his actions.
