I have attended DUI/DWI seminars across the country now since 1998 when I first realized how complicated a DUI/DWI case can be. I have taken numerous breath test courses and am a certified operator on three separate breath test machines including the ECIRII. In fact, I am one of only a handful attorneys in all of Virginia certified as an operator on the ECIRII. I also have a technician certification on the Intoxilyzer 5000. I have personally held ECIRII breath test seminars in Virginia on two separate occasions. I had attorneys from eight states attend my seminars as well as Judges from here in Virginia. I invited the leading experts in the country to speak. Besides my expertise in breath testing, I have taken and passed the same NHTSA Field Sobriety Course that our police officers have to take. I also have attended numerous courses on blood testing for both drugs and alcohol. You never stop learning, so I continue to attend two to four seminars across the country every year to keep up with the latest techniques and strategies for fighting DUI/DWI cases. Due to my focus and training in the area of DUI/DWI defense I was honored to be selected out of all the attorneys in Virginia to write the book for lawyers. Honestly it is one of the highlights of my career. I stole the speech from Larry Taylor who is one of the Godfather’s of modern day DUI/DWI defense. It is a great speech! As a DUI/DWI attorney, I truly am on the front lines of protecting our Constitutional rights. People say “oh he got off on a technicality.” Really what they should say is, “his lawyer protected all of our Constitutional rights, by ensuring the government didn’t get away with something they should not have done!”

Dave began his career as a prosecutor in the Denver District Attorney’s office. He then went to the US Attorney’s Office in Denver where he was the Coordinator for the Mountain States Drug Task Force as part of the Organized Crime Drug Enforcement Task Force newly formed in 1982. In 1985, Dave was appointed by then Governor Lamm as the District Attorney for the First Judicial District of Colorado that includes Jefferson and Gilpin Counties. He was elected in 1993 and remained as the elected DA until 2005 when he was term limited. In 1987, Dave was appointed by Governor Romer to be the Executive Director of the Colorado Department of Public Safety. He held that position until he was elected District Attorney in 1993. During his tenure, he attended the Harvard University Executive Course for Senior Government Executives. Dave was the Executive Director of the District Attorney’s Council for three years in 2005. During that period, he was appointed by the Chief Judge for the Fifth Judicial District to be the Acting District Attorney in the Fifth Judicial District that includes Huerfano and Las Animas Counties. Dave joined Defense Attorneys Maureen O’Brien and Fred Bibik in 2008 where he practiced criminal defense until 2022. Dave joined with his daughter, Attorney Carrie Kollar, in October 2022 to January 2024. Dave’s background includes litigating sex crimes, DUIs, drugs, murder cases, crimes against children, felonies, traffic and financial crimes.

Attorney Jim Vieh earned his undergraduate degree, cum laude, in Government from Harvard. He earned his law degree, as well as an MBA in Finance, from Cornell University. After graduation, he worked for a prominent Phoenix civil litigation firm practicing insurance defense in civil litigation and auto accident cases. He opened his own practice in 1982 & has focused on personal injury and commercial litigation, with additional emphasis on civil litigation & automobile cases. Over the years, his practice has expanded to the areas of business, real estate and commercial litigation. Mr. Vieh is an AV Rated attorney and is admitted to practice before the Arizona State Courts, the United States District Court for the District of Arizona and the 9th Circuit Court of Appeals. He is a member of the Arizona Trial Lawyers Association and the Arizona State Bar and serves as a judge pro tem on the Maricopa County Superior Court. In addition to his legal work, he served two terms on the Paradise Valley Town Council, one term as vice-mayor & formerly served as the Chairman of the Board of the Valley of the Sun School and Habilitation Center, which provides housing & care for persons with disabilities.

I graduated in 1993 at Faulkner School of Law with honors and was a member of the justice court. I have had my trial practice for 24 years which is a 2nd generation law practice and has existed in Mobile and Baldwin Counties of Alabama for over 50 years. My practice areas are Bankruptcy, Criminal, DUI, Personal Injury which includes: Maritime, Auto-Accidents,Workers Compensation and other type cases.

Josh Mitchell graduated from Jacksonville State University in 1996 and studied law at the Birmingham School of Law where he graduated in 2000. He was a Law Clerk for the Honorable N. Daniel Rogers Jr., Circuit Court Judge, 10th Judicial Circuit of Alabama from 1997 to 2001. He then joined as a partner with Bouloukos, Oglesby and Mitchell. He is a former Public Defender for the City of Leeds, Alabama and is a member of the American Bar Association, the Alabama Bar Association, the Alabama Association for Justice, the Birmingham Bar Association, and is a member of the Small Firm Section and the Bankruptcy Section of the BBA.

Kevin Fitzgerald was born and raised in Cleveland, Ohio and is proud of his Midwestern roots and work ethic. Although neither of his parents are attorneys, Kevin jokes that he was “raised” by plaintiffs’ lawyers. He first began working at a plaintiff’s injury law firm when he was fifteen years old and a sophomore in high school. For the ten years prior to attending law school, Kevin served as a litigation assistant at a national law practice where he worked closely with the firm’s trial team representing clients injured by asbestos-containing products. Kevin graduated with a Bachelor of Arts Degree in History and Minors in Geology and Geography from Miami University in Oxford, Ohio. Kevin attended the University of Maine School of Law where he graduated with honors. During law school, he served as Editor-in-Chief of the Ocean & Coastal Law Journal. Kevin was the recipient of the American Bar Association’s Award for Excellence in Land Use and Local Government Law, an outstanding scholastic achievement award in Environmental Law, and the Horace S. Libby Memorial Scholarship. In 2015, Kevin founded the Fitzgerald Law Group, LLC where he continues to concentrate his practice in representing men, women and children injured by medical devices, prescription drugs, over-the-counter products, asbestos, and in wrongful death and serious personal injury cases. Prior to founding the Fitzgerald Law Group, LLC, Kevin worked for another national mass tort law firm for fourteen years, serving as its managing attorney from 2008 to 2015.
