Cases

BUTLER V. STATE

Appellant: Attorney for the appellant, Karan Butler. Buter appeals the denial of her plea and motion to dismiss her indictment based on a violation of her right to a speedy trial. Butler was arrested on May 30th, 2007 and not indicted until October 4, 2007. Her subsequent motion for bond was denied and she remained incarcerated. Problems with counsel led to her filing a grievance with the state bar of Georgia. Her trial date was not set until March 1, 2010. Butler filed a plea in bar and motion to dismiss which was denied. Butler appealed this decision. Upon review of the case history an appeals court found in favor of Butler. They agreed that Butler's constitutional rights were violated and the only remedy was the dismissal of the indictment with prejudice. As such the case was discharged and Butler was acquitted.
