TECHNICAL COATING APPL. V. U.S. FID. GUAR

Defendant: Attorney for the defendant/appellant, United States Fidelity and Guaranty Company. This case is an appeal to an insurance contract case. USFGC appeals the district courts conclusion that, under a Florida law, an "absolute pollution exclusion" is ambiguous when applied to the emission of vapors from products used in their normal manner. Upon review of the case, as well as the laws which determined the original decision, the appeals court finds that the district court erred. The order granting partial summary judgement against USFG is vacated.

CORNELL v PRINCESS CRUISE LINES

Attorney for the Respondents in a case in which Princess Cruise Lines/Carnival Cruises was sued by the Plaintiffs in a lawsuit that was described as frivolous in nature. This suit was actually the second suit filed by the Petitioners The first related to artwork purchased by the Petitioner onboard a cruise in which the Respondent purchased two paintings. After returning home, the Respondent cancelled the order and expected all funds to be returned. Per the contract signed, a little over 500 was kept as a fee. The Petitioner sued the art company (not the cruise line) and refused to settle, even when the company offered a settlement in excess of the amount the Respondent felt was owed. Because the Petitioner's husband was an attorney, the company felt she was pushing a frivolous lawsuit in order to collect attorney fees and after racking up over 80k in attorney fees themselves, the Respondents were able to get the Petitioner to agree. Soon after signing, the Petitioner filed a second suit because Princess Cruise line refused to let her book another cruise (said company felt her litigation tactics were abusive.) After two years of court and Appeals, the case was dismissed.
