About Steven

Steven E. Formaker assists clients in adversarial proceedings. His experience covers a broad range of legal subjects, including contract disputes, real estate, insurance, fraud claims, construction litigation, and contested probate matters. Steve strives for cost-effective resolution of disputes for his clients. He is a vigorous advocate, but avoids contentiousness over matters that do not advance his clients' interests.

Steve has represented clients in proceedings in federal and state court and before private arbitration panels, and has taken numerous cases to trial. He has briefed and argued appeals before the United States Court of Appeals for the Ninth Circuit, the California Court of Appeal, and the Appellate Department of the Los Angeles Superior Court. A lifelong Californian, Steve lives in Los Angeles with his wife and daughter.

Notable Results:

  • Successfully defended trust against deceased trustor's second wife's attempt to assert the invalidity of the trust instrument and claim a community property interest in trust proceeds that the trustor had directed to go to his children from his first marriage. The attack on the validity of the trust instrument was disposed of by summary judgment; the balance of the case was resolved at trial.
  • Defeated claim for breach of contract and fraud asserted by purchaser of real estate upon summary judgment and obtained an award of attorney's fees against the plaintiff. Prepared briefs for appeal from the summary judgment and attorney fee orders, which were affirmed in their entirety.
  • Obtained a United States District Court judgment enforcing an insurer's right to reimbursement of deductibles pursuant to its insurance policy.
  • Won a jury verdict exceeding $3,000,000 in a dispute regarding defective controls for steel manufacturing equipment.
  • Prevailed in the defense of lawsuit concerning control of a corporation and claims of misappropriation of corporate opportunity, winning a jury verdict on all but one of several claims, and securing a court judgment on the remaining claim.
