Mr. Weaver handles all aspects of civil litigation in the North Carolina state court system. In addition, Mr. Weaver handles most of the firm’s federal court cases, including defense of health care providers in cases alleging civil rights violations. Mr. Weaver also handles defense of medical malpractice actions. Within the field of insurance defense, Mr. Weaver handles defense of general liability cases involving a wide array of issues such as motor vehicle liability (third-party and UM/UIM), premises liability, products liability, damage to real and personal property, alleged unfair claims settlement practices, and alleged unfair or deceptive trade practices. Mr. Weaver prepares insurance coverage opinions on a variety of issues including sexual harassment, mold, coordination of coverage, the scope of insurers’ duties of defense and indemnity, cancellation and rescission of insurance policies, as well as various other issues specifically pertaining to N.C. Gen. Stat. § 20-279.21 et seq. Mr. Weaver also handles declaratory judgment actions brought by or against insurance companies. Finally, Mr. Weaver handles most of the firm’s appellate work, including appeals to the North Carolina Industrial Commission, the appellate courts of North Carolina and the United States Court of Appeals for the Fourth Circuit.
