About Stewart
Stewart joined Schwarz McNab & Bailey at the end of 2001 and is a member of CSM&B. He has been practicing in all areas of civil litigation since 1985. In his twelve years as an associate and then a partner at Morrison & Foerster, Stewart represented clients in litigation matters in state trial courts in Colorado, Idaho and New Mexico, and before federal courts in Colorado, Kansas, New Mexico, Virginia and Wyoming. He represented a major property and casualty insurer, as lead counsel, in insurance coverage cases involving environmental clean up costs arising from mining, petroleum storage, chemical manufacturing and landfills. He defended a major Denver area land developer and former home builder in a class action lawsuit alleging defects in approximately 1,000 houses. Stewart successfully challenged a local government's denial of a special use permit for a group home for developmentally disabled children.
Since leaving his large-firm practice, Stewart tried the first ADA Title III access case to go to trial in Colorado; represented a biotechnology company in resisting disclosure of trade secrets about a proprietary DNA testing process in a criminal prosecution; defended a research scientist accused of scientific misconduct in federally funded research projects; and defended a founding shareholder of a technology start-up company in a derivative case brought by another founding shareholder. He represents a national retailer in litigation matters across the country. Stewart has also handled matters involving product liability, UCC warranties, contract disputes, common law claims for environmental contamination, water well contamination, insurance disputes, employment contract litigation, construction delays, covenant violations, professional malpractice, lender liability, collections, foreclosure and receivership.
Stewart graduated from The Colorado College in 1976. He worked for a time as a ground water geologist, including giving expert testimony in Colorado's Division One Water Court, and received his J.D. from the University of Denver in 1984. He is admitted to practice in all state and federal courts in Colorado, as well as the United States Court of Appeals for the Fourth Circuit.
