Please describe a case in the last year or two where you made a big difference.
Our firm has been fighting for the rights of the injured and disabled of Colorado since 1977, and like to believe that we help make a difference for all of our clients. On occasion, we also get to help make a difference that effects even our non-clients. Last year, we helped take on a large employee benefit program that had attempted to shorten the statute of limitations for filing a lawsuit, and included in its policy a provision requiring Colorado workers to litigate in another state. That case, under the Employee Retirement Income Security Act of 1974 (ERISA) went all the way to the Court of Appeals. We were successful in striking down both of those provisions (which could help workers all through the State of Colorado).
How did you build a successful practice?
Dedication. Passion. Experience. These are the 3 cornerstones of our philosophy. We believe that all of our clients deserve the same high level services that the large insurance companies and corporations that oppose them have. While our name has changed, our philosophy and dedication to the needs of our clients and their families has not. 40 years later, we continue to strive to provide the quality representation offered by the “big law firms”, while we maintain the intimacy, personal service and attention to detail of a small firm.
What should clients look for in a lawyer?
On our firm website (www.silvernbulger.com), letterhead and business cards, we proudly state we are "attorneys and counselors at law." We believe that is more then a formal title. It is important that a lawyer have the experience and skills to fight for a clients' rights. However, and just as important, is the ability to give a client clear and frank advice. You should not look for a lawyer who "tells you want you want to hear", or promises "million dollar" results (there is always a disclaimer in the fine print). You should look for a lawyer that tells you what you need to hear, and allows you to make fully informed decisions about your case.
How important is local knowledge to the success of your cases?
Very. Laws vary state to state. Procedures also can vary from State to State, and even between Courts in the same state. The Colorado and Federal systems can also be very different. It is important to make sure the lawyer you are working with practices law in the Court that your case will be heard.
What information can you provide in a free phone consultation?
We are often asked ... "what is my case worth"? Frankly, be careful of any lawyer that answers that question. Personal injury and other cases are very fact specific, and the details matter. Based on an initial consultation, we can provide an initial assessment. More importantly, we can help you identify the strengths and weaknesses of the case, and outline a plan for moving forward. What happens after the initial consultation is far more important. Once we begin working on a case, we immediately begin collecting all of the information needed (traffic reports, medical records and bills, photos, etc.) and regularly update our evaluation.
What information do you need in a free phone consultation?
When you first meet with a lawyer, it is important to have all of the basic information available. When, where and how did the accident happen? Were there any witnesses? What doctors have you seen? is more treatment expected? Have you been in contact with the defendant or his-her insurance company? More importantly, have you thought about the questions you want to ask? What is the lawyer's experience with these cases? Background? Fee structure. Always remember ... you are interviewing the lawyer (not the other way around!)

What is the most rewarding aspect of your job?
We have a passion for the law, and for fighting for the rights of our clients. Knowing thjat we can help make a difference during the difficult time our clients are facing is the biggest reward. Our lawyers have experience prosecuting many large and small cases to trial, frequently attaining successful verdicts. At Silvern & Bulger, P.C., we believe any lawyer can settle a good case for something. The true test of a firm is its willingness to fight on difficult cases as well. Further, our trial successes enable us to accomplish good settlements, not just any settlements.
What are your other interests in addition to law?
As a law firm, we believe in giving back to our community. Over the past several years we have been proud to support several local schools (including as a proud supporter of Highline Academy Charter School) and charities, as well as the arts (like the Arvada Center for the Performing Arts) and other community programs.
