Defendant: Attorney for the defendant, PACTIV Corporation and Prairie Packaging Inc. The plaintiff-appellant, James Brooks was seriously injured while working for the defendant-appellees. As a result of the accident the plaintiff lost his left arm up to the elbow. He filed for permanent and total disability as a result of his injuries. His employer kept him on as an employee on an extended leave of absence so he could continue to receive critical medical care. When the company was purchased by PACTIV they discontinued this arrangement and Brooks was terminated. Brooks filed a complaint that was dismissed because Brook's failed to state a claim. He appealed this decision. Upon review of the case the appeals court partially affirmed the judgment and reversed the dismissal of the state-law retalitory-discharge claim. The case was remanded for further proceedings.
