We require an advance payment for services before we will undertake any representation and such payment is due upon engagement. The amount we charge prior to undertaking a particular representation depends entirely on the unique set of facts and circumstances related to the representation in question. Such considerations include, but are not limited to: (1) the time and labor required, the novelty and difficulty of the questions involved, and the skill requisite to perform the legal service properly; (2) the likelihood that the acceptance of the particular employment will preclude other employment by Attorney Hartley; (3) the fee customarily charged in the Dayton and Kettering, Ohio, area for similar legal services; (4) the desired result; (5) the time limitations imposed by the client or by the circumstances; (6) the nature and length of the professional relationship with the client; and (7) the experience, reputation, and ability of Mr. Hartley.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

In the past few months, I've won several custody cases on an emergency and permanent basis, for fathers who have no parental rights at all, merely standing to pursue such rights. One case is ongoing. In the second case, my client, the father, received shared parenting and he is the residential parent for school placement purposes. In the third, we had a trial and we won custody. In a fourth case, my client already had custody, mom wanted to change that, and we won a trial to keep custody.

How did you build a successful practice?

I've built a successful practice based off of hard work, being extremely accessible, self-sacrifice, attention to detail, offering honest and frank advice (whether or not it's what my client wants to hear), not over-promising and in fact over-delivering or otherwise exceeding client expectations, knowing when to negotiate and knowing when to be aggressive, and winning cases. I have satisfied after satisfied after satisfied client.

What should clients look for in a lawyer?

Client's should look for knowledge, experience, and track-record.

How important is local knowledge to the success of your cases?

Local knowledge is a tricky question. Attorneys should be competent and inasmuch as they are admitted, there is a presumption that the attorney is competent to handle pretty much anything. However, attorneys who focus on particular practice areas tend to have relationships with the bench, opposing counsel, hard-earned credibility, knowledge of local rules, and aren't general practitioners who may be a bit out of depth in a particular practice area, like family law, contested divorce, property division, spousal support, etc.

What information can you provide in a free phone consultation?

I can analyze a case fairly quickly, advising a client about their rights based on what they tell me, evaluating whether there is merit to a potential claim (e.g., spousal support in a divorce, motion to allocate or reallocate parental rights and responsibilities; modify parenting time), what the next step in the process is, etc.

What is the most rewarding aspect of your job?

I enjoy and my life is devoted to shouldering other peoples burdens, taking on their problems, and solving problems, making lives, particularly kids, better.

What are your other interests in addition to law?

I am a huge fan of U.S Soccer. I love my family.
