PROCUNIER V. NAVARETTE

Respondent: Attorney for the respondent, Navarette. Navarette was an inmate of Soledad prison. He accuses the prison of violating his constitution rights Specifically withholding his mail from him, cutting off critical access to his legal team. A court found in favor of Navarette finding that he had presented sufficient evidence to support his claim. It was also determined that even as a prisoner, he entitled to certain constitutional rights. At question in the end was whether or not the employees of the prison knowingly violated his rights. Upon review of the case and the question at hand, the judge dissent from decision citing that the question was not properly presented to the court.
