Upon the successful accomplishment or disposition of the subject matter of this agreement, 33 1/3 % of gross recovery. (3) The client is not liable to pay compensation otherwise than from amounts collected for him by the Firm, except as follows: Reasonable expenses and disbursements. Reasonable contingent compensation is to be paid to the Firm for such services, but such compensation (including that of any associated counsel) is not to exceed the following maximum percentages of the gross amount collected: 33 1/3% of the amount collected whether by settlement, judgment, verdict, finding or by any order, judgment or decree of any court. In the event of any appeal, the client shall be liable to pay to the Firm, such further moneys as may be agreed to between them if such appeal becomes necessary since this agreement does not include and is not concerned with any appellate work which this case may require. The client is in any event liable to the Firm for their reasonable expenses and disbursements. The client further agrees that from the proceeds of any recovery, either by settlement, judgment or otherwise, the Firm may deduct in addition to the Attorneys' fees, costs, and expenses, all unpaid doctors and hospital bills and related items making disbursement directly to the hospital, doctor, etc., concerned. This Agreement and its performance are subject to Rule 3:05 of the Supreme Judicial Court of Massachusetts.
