In re Verbick, 607 N.W.2d 148 (Minn. Ct. App 2000)
Defended the city of Babbitt in an action to vacate a city street. Upheld by Minnesota Court of Appeals. Decision based on evidence that the street was still being used for its intended purpose, among other things, as a means to access and maintain utilities and for vehicle traffic.
