About Clint

PLEASE VISIT MY WEBSITE AND WATCH MY VIDEOS AT WWW.KELLYFIRM.NET. I am an attorney on NewsChannel 5 in Nashville and on NewsChannel 5+ "Morning Line" show with Nick Beres. I have been fascinated with medical issues ever since my first medical malpractice case. These cases involve the best lawyers in town fighting with uncommon vigor and commitment. I have never handled an easy or routine medical malpractice case. There is no such thing. Even when the liability seems obvious, creative lawyers for health care providers raise tough defenses. The skill and reputation of the defense lawyers drives me to work harder and be more prepared in these cases. The patient’s catastrophic injuries patients add pressure to the trials. I have an enduring passion for these cases. This is why medical malpractice constitutes about 90% of my practice. This is why I obtained certification as a medical malpractice specialist. I have won and settled over $30,000,000 for clients in my career. I love what I do. I wrote a book called KELLY ON MALPRACTICE 2.0 because there is no other text devoted to medical malpractice litigation in Tennessee. I wrote this book for lawyers, judges, clients, and interested members of the public as a reference. This book contains my opinions about medical malpractice law in Tennessee. Here are the beatitudes for my law firm:

Be EXCELLENT           To seek justice for our clients no matter what.
Be HONORABLE         To maintain our integrity as officers of the court.
Be DETERMINED        To search for the truth wherever it leads.

Be PROUD                    To help our clients get justice in difficult economic times.
Be HELPFUL                To our staff and clients because success is a team effort.
Be JOYFUL                   To win our client’s trust, satisfaction, and deep appreciation.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

I represented a Vietnam veteran who was part of a Gold Star family that lost a soldier son in Operation Desert Freedom. This veteran needed spine surgery to relieve radicular nerve pain in his left leg. During surgery, the surgeon caused a slow bleed in the dura that was ignored for 4 days by the hospital staff. Another surgery to correct the bleeding came too late to prevent paralysis. The patient hired me to sue the hospital. I learned that the surgeon had delegated postoperative monitoring to his nurse practitioner who had little experience managing bleeding complications from surgery. The nurse negligently attributed the creeping paralysis to diabetic nerve paraesthesias instead of postoperative bleeding. This is why no one intervened to stop the bleeding for 4 days while the patient was becoming paralyzed. I obtained a multimillion-dollar settlement for the client which was used to fund a life care plan for his future health needs, to build a new house that was "wheelchair friendly," and to buy a all terrain vehicle. I take great pride in helping one of our Gold Star families.

How did you build a successful practice?

You work hard to represent all clients like they are part of your family. I ask myself would I be satisfied with the money recovered if I were the client. I also invest in technology that helps me produce settlement brochures and litigate at trial. Most important is being honest and candid with clients so they get the best advice to make critical decisions.

What should clients look for in a lawyer?

Go online and search for a board certified lawyer. They are specialists and recognized as the best in their field by other lawyers and professional legal organizations. They are the best trained and have the most experience in handling the kind of legal service you need. Word of mouth is also good predictor of quality legal service. Check with friends who have been represented in personal injury cases or medical malpractice litigation. If you have had a lawyer, ask him or her for a referral. Divorce or criminal lawyers can refer to the right specialist.

How important is local knowledge to the success of your cases?

It is very important. Always prefer a lawyer who practices in your city or state. These lawyers have a better feel for jurors they may have to select at trial. Unfortunately, there are national law firms that advertise bigly on TV with saturation in locations where they don't practice. They will sign up the client over the phone and then handle the case from an office in another state using paralegals or administrative personnel. In the alternative, these firms refer the case to a local lawyer who is not in the commercial and may not be as good.

What information can you provide in a free phone consultation?

Some lawyers charge by the hour while others charge a flat fee for services. Other lawyers charge a contingent fee, which means they get paid only if they recover money for you and they take a percentage (usually 1/3) of the money they recover on your behalf. Medical malpractice and personal injury lawyers should not charge you anything until they recover money for you. When a lawyer says that he will provide a free consultation it means that he or his staff will talk to you, perform an in-depth interview, hear about your problem, and give an opinion for no fee or expense to you. The lawyer will take your case or may decide that he can't take the case. The reasons he can't take you case are that he doesn't think he can win it, it would cost too much money to take, or there may be a conflict of interest.

What information do you need in a free phone consultation?

All contact information, Contact information for potential wrongdoers, Complete background of what happened, Description of all injuries and whether they are permanent, Tally of all medical expenses and lost wages to date.

What differentiates you from other lawyers in your community?

I am a board-certified medical malpractice specialist. I am recognized as the best in this field by other lawyers and professional legal organizations. I have a wealth of experience handling cases involving hospital mistakes, surgical errors, medical malpractice, and nursing home neglect. I have had over 50 jury trials as lead counsel and junior counsel in my 26-year career. This is why I am also good at handing personal injury and wrongful death cases from car wrecks and defective products. I have represented several patients with spinal cord injuries who are confined to a wheelchair, amputees who need the best computerized microprocessor prosthetic legs, burn victims who need skin grafts, and brain damaged patients who need a life care plan.

What is the most rewarding aspect of your job?

Customer satisfaction, pure and simple. Helping clients get the money they need to restart their life.

What are your other interests in addition to law?

I love playing golf and boating. I love the smell of autumn air when I can enjoy watching NFL football and college football. I enjoy hunting doves in September. I have multiple guns and I'm not afraid of using them. I've learned to be a good shot with a handgun.

Are you involved in your community?

I attend church as much as I can. I follow our neighborhood watch association.
