About David
After graduating from Yale, Boies joined the firm Cravath, Swaine & Moore, becoming a partner there in 1973. He left in 1997 to start his own firm called Boies, Schiller & Flexner LLP. His career has also spanned government; he was named Chief Counsel and Staff Director of the United States Senate Antitrust Subcommittee in 1978 and Chief Counsel and Staff Director of the United States Senate Judiciary Committee in 1979. In addition to practicing law, Boies has taught courses at the Cardozo School of Law and New York University Law School.
Throughout his legal career, Boies has litigated a number of notable cases. While at Cravath, he defended IBM in 13-year antitrust cases brought by the Justice Department and private competitors; in a separate case, he represented the Justice Department in United States vs. Microsoft. Other well-known organizations that Boies has defended include the New York Yankees, CBS, and Vice President Al Gore in the 2000 U.S. Presidential case of Bush v. Gore. In 2003, Boies represented the CFO of Enron.
In 2006, Boies negotiated a large settlement with his firm, Boies, Schiller & Flexner LLP. The case continued through 2015, when Boies won a claim that a multi-billion-dollar governmental bailout of AIG was unfair to the company’s owners. The firm also helped the US government secure a $155M settlement from Medco Health Solutions.
In 2009, Boies was involved in the fight to overturn Proposition 8, California’s ban on gay marriage. The case worked its way to the Supreme Court of the United States, which declared the proposition unconstitutional. Boies also helped the Golden Gate Yacht Club resolve an ongoing dispute with a yacht club in Geneva, Switzerland.
In the sports world, Boies represented Jamie McCourt in her divorce from Frank McCourt, owner of the Los Angeles Dodgers. He was part of a legal team that represented the National Football League in the highly-publicized case of Brady v. NFL and represented the National Basketball Players Association in a 2011 NBA lockout and football players in the 2011 NFL lockout.
In business, Boies appealed a verdict for a smoker’s death in 2012. He argued on behalf of Philip Morris USA Inc., R.J. Reynolds Tobacco Co. and Liggett Group LLC in a $2.5M appeal. Later in 2012, he defended the president of Academi in a federal prosecution alleging that he and co-defendants illegally hid firearms from the Bureau of Alcohol, Tobacco, Firearms and Explosives. Boies has also been Chief Counsel for Sony Pictures Entertainment and attorney for the Silicon Valley startup called Theranos.
