QUESTIONNAIRE
In one case for an optometrist, I successfully reduced the business debts by approximately $300,000 and restructured the remaining debts over an extended period of time with reduced interest. In two cases during the preceding two years I helped reduce a debtor's student loans by a combined total of more than $300,000.
How did you build a successful practice?First, by being approachable to my colleagues and earning their respect. Attorney referrals are an critical component of my success, just as the respect of my colleagues helps me to negotiate resolutions for my clients much more efficiently. Second, customer service. At every step, my goal is to understand my clients and their goals, and craft a creative solution to achieve those goals.
What should clients look for in a lawyer?Honesty. It is easy to sign up with an attorney who promises a lot for a little. Don't just take the easy answer. A good attorney should be able to explain the good and the bad, the rewards and the possible risks, including the potential attorney fees that may be incurred.
How important is local knowledge to the success of your cases?Local knowledge is critical in many ways. First, only a Kansas attorney understands Kansas exemptions, a basic component of bankruptcy. Second, local attorneys understand the judges. Many judges take different positions on the same issue. I recently had a potential client tell me that he had read something online that contradicted what I said, and therefore I was wrong. What he didn't know is that the issue in question was not settled law, and the judge in his case took a different approach than his "online" resources.
What information can you provide in a free phone consultation?In most cases, I can determine whether a bankruptcy makes sense, if so, what type of bankruptcy, and offer a general overview of the fees involved and the general benefits. If the phone consultation indicates that retention is a good idea, an office consultation is extremely beneficial to flesh out the details of the case and make sure that nothing is missed.
What information do you need in a free phone consultation?Amounts of debt by category (credit cards, medical, student loan, vehicles, home mortgage, etc), a list of assets (cars, house, toys, jewelry, collectibles, investments, etc.), gross monthly (or annual) income, and the overall goals of the client.
What differentiates you from other lawyers in your community?I have client ratings listed on several websites (Avvo.com and Martindale.com) giving me five out of five stars. I am also listed on the SuperLawyers® list and have received Martindale-Hubbell's® AV™ Rating. I expect to receive my Business Bankruptcy Specialist Certification from the American Board of Certification in April 2015, which would make me the only certified specialist within 100 miles of Wichita. Finally, I have represented all sides of the bankruptcy system, including the United States Trustee, chapter 7 trustees, debtors, and creditors.
What is the most rewarding aspect of your job?Relieving families from huge financial burdens and saving local jobs by enabling businesses to stay in business.
What are your other interests in addition to law?Motorcycling, hiking, and cooking are my three favorites!
Are you involved in your community?Yes, especially at church. I am 3rd Degree member of the Knights of Columbus, and we do a lot of charitable events for the disabled and impoverished in our community and our world.
