About David

Dave McClurg is a member of the firm's Labor + Employment practice group. He has a long record of successfully defending employers accused of wrongful termination and discrimination on the basis of race, religion, age, disability, and gender. Dave frequently represents employers facing OSHA violations and workers' compensation claims alleging safety violations or an “unreasonable refusal to rehire" following a work-related injury. He also has a wealth of experience involving the litigation of wage & hour, theft of trade secret and breach of duty of loyalty claims, and the enforcement of non-compete and confidentiality agreements. In addition, Dave regularly advises clients on issues relating to reduction-in-force layoffs, terminations, severance agreements, and return to work issues, helping employers avoid pitfalls that can lead to expensive claims.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

I successfully defended a disability discrimination claim against one of my clients that was appealed all the way to the U.S. Supreme court. Severson v. Heartland Woodcraft established that an extended leave of two months is not a "reasonable accommodation" under the Americans With Disabilities Act, and that an employee requiring such an extended leave does not fall within the scope of the protections afforded by the ADA.

How did you build a successful practice?

I have developed loyal clients by providing a thorough analysis of their legal problems from the outset of my representation that effectively limits their exposure to liability and promptly brings litigation of claims asserted against them to an end.

What should clients look for in a lawyer?

Honesty, integrity, responsiveness, experience and solid communication and analytical skills.

How important is local knowledge to the success of your cases?

It is very important to be familiar with the local judiciary and the Administrative Law Judges that decide employment related cases under the Wisconsin Fair Employment Act. My familiarity with these judges and their predilections, based on over 30 years of legal practice in Southeast Wisconsin, provides my clients with a significant advantage when claims are asserted against them.

What information can you provide in a free phone consultation?

In addition to a general explanation of the laws relevant to their legal questions, I can help a potential client identify the type of information that will be needed to fully evaluate their issues or potential liability in connection with a claim that may have been asserted against them, the time frame in which I might be able to provide a response to their questions if they decide to retain me, and the terms under which I would be willing to represent them.

What information do you need in a free phone consultation?

The names of the parties involved in order to run a conflict of interests search and basic background information relating to the legal question or issue that the potential client is interested in having reviewed.

What differentiates you from other lawyers in your community?

My extensive experience, individualized service and thorough preparation.

What is the most rewarding aspect of your job?

Helping clients unburden themselves from the stress of legal entanglements that they are not equipped to deal with themselves.

What are your other interests in addition to law?

I am an avid motorcyclist and a flute player.

Are you involved in your community?

Yes, I'm our firm's representative to the Waukesha Business Alliance, and a Board member and former president of Corporate Casual, a longstanding member of the Barristers Club and a number of other networking groups.
