David began his career with RHRC in January 2002, bringing with him years of experience in and knowledge of construction, building codes, and related fields. He holds expert status and certification in 12 code classifications and is an International Code Council Certified Building Official. Few, if any, attorneys have David's knowledge, expertise, and experience in the construction field. His unique background in construction and governmental entities, combined with his personal and professional real estate experience, enables him to handle a wide range of common issues and transactions arising out of residential and commercial construction and real estate scenarios. David focuses on cases involving construction defects, contractor licensing issues, construction transactions and litigation, and general real estate transactions and litigation.
 
NOTABLE LITIGATION
 
In Re: Dunivin v. Nasmeh, et al. (Santa Clara County Superior Court Case #CV787333). Represented sellers of residential real property in Saratoga. The buyer was a local real estate agent/developer. It was established in discovery that the buyer intended to defraud the sellers. The case settled for full value on the first day of trial.
 
In Re: Westendorf v. Sani, et al. (Santa Clara County Superior Court Case #1-03-CV-816608). In a two-week jury trial, successfully prosecuted a nondisclosure case against sellers of residential real property in Willow Glen. The sellers, two lawyers, failed to disclose mold at the property. The jury awarded buyers full damages and attorneys' fees.
 
In Re: Hogue v. Myer, et al. (binding arbitration). Prosecuted a case for buyers who discovered that their high-end home in the Los Gatos Foothills had non-disclosed defects which would cost at least $150,000 to repair. Obtained a judgment in the buyers' favor for the difference between what they paid for the property and its actual worth its true condition.

PERSONAL
David is married to Shelly Stevenson-Roberson, and they are blessed with three wonderful children, Harrison, Hailey, and Spencer.
 
David is an avid sportsman who played organized baseball from age 8 until age 23 and adult league ice hockey from age 23 until age 30. At age 30, he began training as a triathlete. He is a three-time finisher of the Hawaii Ironman World Triathlon Championship (1993, 1994, 1995). In the 1994 season, Triathlete Magazine and Triathlon Times Magazine ranked David #1 in his 30-34 age group in the United States, a group comprised of over 35,000 U.S. age group triathletes. David has also finished eight marathons, over 40 triathlons, and 20+ 10K races. Currently, David is an avid runner, skier, hiker, and golfer.
