My law office concentrates on helping individuals organize and plan for the transfer of their wealth and assets upon their death. You may be thinking, why should I think about planning for the transfer of my assets when I die, now? After all, me and my family are doing great. I know that this is a very sensitive and intimidating subject for most people to discuss. However, take a moment to think about the alternative. What if you didn’t engage in any estate planning before you die? Would you want no control over how your assets are handled after you have worked so hard for many years to accumulate them? Would you want the state to determine what happens to your assets upon your death?
The fact is, if you don't have an estate plan in place, you are far from being alone. Did you know that 60% of adults in the United States don't have a Will? The reality is, having a Will along with a properly crafted estate plan is the last opportunity to legally declare how your property is to be divided when you die.
Keep in mind that an estate plan is more than just a Will. It also involves producing documents that meet your wishes regarding managing your health and financial needs if you become incapacitated and can no longer do so. It may also involve utilizing trust documents to manage your assets while you are living, prevent a guardianship proceeding or to address the issues involved with a child who has special needs.
